Galveston Woman Suing Blue Bell Creameries Over Allegations From 2015 Listeria Outbreak

Ursula Burton is seeking between $200,00--$1 million in damages claiming ice cream made her lactose intolerant, daughter dairy sensitive

GALVESTON, TX -- A Galveston County woman is suing Blue Bell Ice Cream alleging that she and her daughter contracted listeria after eating Blue Bell Ice Ice Cream.

Ursula Burton, who filed the lawsuit on April 17, claims in her lawsuit that in April 2015, she purchased Blue Bell Ice Cream from a Valero gas station, and that both became violently ill after eating the ice cream.

“As a result of eating the contaminated Blue Bell ice cream, plaintiff Ursula Burton was diagnosed with listeriosis,” the lawsuit says.

Burton also claimed in her suit that she has become lactose intolerant, and that her child has also developed a sensitivity to dairy products as a result.

It was in 2015 that Brenham-based Blue Bell Creameries, located about 80 miles west of Houston, were forced to pull their products from the shelves of grocery stores nationwide, and recall all of their products after nearly a dozen listeria cases were reported.

Burton is seeking $200,000 to $1 million in damages for pain and suffering, anguish, medical expenses, and damages from physical impairment and lost wages.
