The wife of the 41-year old man, an off-duty Harris County Sheriff’s deputy, arrived at the restaurant and saw the scuffle, and went to help her husband restrain Hernandez, KPRC reported.

The deputy called for backup and medical assistance, and when Hernandez stopped fighting, she realized he was not breathing, and began performing CPR until help arrived.

He was taken to LBJ Hospital and is in a coma, KTRK reported

Hernandez’s wife, who was with her husband at the Denny’s restaurant, said her husband had been drinking and had gone outside to urinate.

She told KTRK that the man who confronted her husband had him on the ground and was punching him repeatedly.

However, the man said he was defending himself from Hernandez, who threw the first punch.

The 41-year old man was handcuffed and placed in a patrol car, but was later released.

Charges have not been filed in this case.

The incident is under investigation by the Harris County Sheriff’s Office.
