Couple Arrested For Public Sex In North Austin

AUSTIN, TX — In "there's-a-time-and-a-place news: A couple was arrested this week after being caught having sex in the middle of the day under a highway overpass in Northwest Austin, according to a published report.
Referencing an arrest warrant affidavit filed on Tuesday, the Austin American-Statesman reported that a man and woman were reported having intercourse in public at around 3:30 p.m. under the overpass on Balcones Woods Drive. The arriving officer is said to have seen the couple, both with pants down, in plain view of passing cars near the top of the bridge, according to the report.
Brittani Maxine House, 33, and Nikita Nickolayei Selivyorstov, 30, acknowledged having sex but said they didn't think it was illegal to do so in public, police said.

But it is. The two were charged with public lewdness, a Class A misdemeanor punishable by up to one year in jail and a maximum fine of $4,000. According to jail records, House was not behind bars as of Tuesday but Selivyorstove remained at the county jail with bail set at $3,500.
