Jeminson is accused of hitting Justin Jones, 37, in the head head with a motorcycle helmet after the two encountered each other at 1 a.m. on Jan. 2 inside the Walmart 27600 Tomball Parkway.

According to court documents, Jeminson and Jones knew each other, and had been involved in a dispute for sometime.

Prosecutors in the case said Jemison could be seen in surveillance video standing face to face with Jones, and while the footage is not very clear, shows some sort of fight and that Jemison's helmet is seen bouncing off a wall and hitting the floor as Jones falls to the ground.

During an initial interview, Jeminson told police that he hit Jones with his fist, and not his motorcycle helmet.

Jones was taken to Memorial Hermann The Woodlands where he was determined to be brain dead, and later died of severe head trauma.

Jemison, who has previous convictions for marijuana possession, assaulting a family member, evading arrest and felony theft, was identified by a witness who knew both men.

If he is convicted, Jeminson faces a maximum sentence of life in prison.
