Repeat Offender Arrested For Indecent Exposure In Clarendon

Arlington police arrested a 41-year-old man for exposure and assault, marking his sixth similar charge in the last decade.

ARLINGTON, VA — A 41-year-old man who was arrested Saturday afternoon in Clarendon for indecent exposure has been arrested multiple times for the same offense over the last 10 years, according to authorities.

Officers responded just after 3 p.m. to investigate a disorderly conduct report in the 1100 block of Norther Highland Street.

"It was determined the male suspect was outside the business when he allegedly exposed himself," according to the incident report. "The suspect then assaulted a victim on the sidewalk a short time later. No injuries were reported."

The officers located the suspect nearby and took him into custody.

Donte Smith of an undetermined address was arrested and charged with indecent exposure with more than three offenses in 10 years, assault and battery, and public intoxication, according to police. He was then held without bond.

Smith was arraigned Monday morning in Arlington General District Court and had a bond hearing scheduled for 9 a.m. on Tuesday, according to court documents. A preliminary hearing was scheduled for 11:30 a.m. on June 12.

Prior to his arrest on Saturday, Smith had been arrested charged with indecent exposure on five previous occasions, including two convictions:

  • May 14, 2024 - Arlington General District Court: Nolle Prosequi (Nov. 26, 2024)
  • Sept. 24, 2023 - Alexandria General District Court: Guilty - 12 months in jail with 8 months suspended, six months of supervised probation and $214 in court costs (Oct. 27, 2023)
  • Aug. 31, 2021 - Arlington General District Court: Nolle Prosequi (Oct. 13, 2021)
  • April 6, 2020 - Arlington General District Court: Nolle Prosequi (Oct. 13, 2021)
  • July 13, 2019 - Arlington General District Court: Guilty - 12 months in jail with 10 months suspended and $150 in court costs. (Aug. 15, 2019)

If Smith is convicted of indecent exposure for the third time in connection to his most recent arrest, he faces the possibility of one to five years in prison or up to 12 months in jail and a fine of up to $2,500, under the Code of Virginia.
