“I should’ve said NO!”

Question:  The cop pulls me over and tells me he wants to search my car.  Of course, I’m stressing out.  He’s bigger than me and I think to myself, “can I say no, and doesn’t he need a search warrant?”

Answer:  Why would you want to consent to a search?  The cop doesn’t always need a search warrant in order to conduct a search.  Some common exception to the search warrant rule are:  consent exception-the person consents to the search;  search incident to arrest exception-the person is arrested and then he can be searched; emergency exception -when the cop has a reasonable fear for safety; plain view exception-contraband is right before the eyes of the cop.
