Fredericksburg Health Inspections: 15 Violations At 1 Restaurant

The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent restaurant inspections.

FREDERICKSBURG, VA — Several facilities in the Fredericksburg area recorded violations during recent inspections from the Rappahannock Area Health District. Inspectors conducted the most recent visits between Oct. 25 and Oct. 31.

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions.

It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.

The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."

Here are the most recent violations as listed by the Rappahannock Area Health Department:

  • Paisano's Pizza, 1515 Stafford Market Place Suite 119 Stafford, VA 22556
    • Date inspected: Oct. 25
    • Total violations: 13
      • Person in charge could not provide certification on food safety management.
      • Person in charge could not provide written documentation for the training of the employee health policy. EHS provided documentation.
      • Person in charge could not provide written clean up procedures for bodily fluids. EHS provided written documentation.
      • Observed several employee beverage containers without lids on a prep table. PIC placed lids on containers.
      • No paper towels in the dispenser at the back hand sink. PIC placed paper towels in dispenser.
      • The concentration of the sanitizer in the 3-compartment sink read 0ppm. The 3-comparmtnet sink was being used. The sanitizing dispenser was attached to hand soap and not sanitizer. The PIC attached the right chemical sanitizer to the dispensing pipe. The sanitizer was replaced in the 3-comp sink and the concentration read 400 ppm.
      • Observed can opener soiled. Item removed to 3-compatment sink for cleaning.
      • Observed the following held at improper temperature in the prep unit on the cookline: several bags of noodles (46-51 degrees), sliced tomatoes (48 degrees F), cut lettuce (51 degrees F), sliced provolone cheese (50 degrees F), sliced salami (48 degrees F), sliced ham (50-52 degrees F), sliced turkey (51 degrees F), feta cheese (52 degrees F), bleu cheese crumbles (50 degrees F), taziki sauce (50 degrees F), cooked chicken wings (48-51 degrees F), mozzarella balls (52 degrees F), and American cheese (49 degrees F). The foods were kept in the prep unit overnight. All foods were voluntary discarded. The PIC stated they will use the pizza prep unit and walk in cooler in the meantime. Technician was called during inspection and is scheduled to come the next day.
      • Observed several food employees without hair restraints.
      • Observed several icicles hanging from the vent of the walk-in freezer. Pieces of ice were on top of boxed frozen foods and the floors of the walk-in freezer. PIC relocated boxed foods.
      • PIC could not provide a test kit for sanitizer.
      • Backflow prevention missing at the Y connecter where hose with a spray nozzle is connected.
      • The exterior top lid of grease receptacle is heavily soiled and encrusted.
  • Arby's, 5426 James Madison Parkway King George, VA 22485
    • Date inspected: Oct. 25
    • Total violations: 2
      • Observed the cutting board along the make line and on the clean pot rack were scored.
      • The hood over the deep fryers were observed soiled.
  • H.H. Poole Middle School, 800 Eustace Road Stafford, VA 22554
    • Date inspected: Oct. 25
    • Total violations: 1
      • Observed the lip of the ice machine soiled. PIC cleaned the surface during the inspection.
  • LaMichi Foodie, 1600 Mine Road Stafford, VA 22554
    • Date inspected: Oct. 25
    • Total violations: 2
      • Observed coffee grinder soiled. Clean prior to use.
      • Absence of adequate backflow prevention connected to the rinse equipment for coffee beverages. Observed backflow preventer connected to the rinse equipment and ice machine above the T-connector. Advised the operator a separate backflow preventer is needed for the rinse equipment. Instructed the operator to discontinue sus until backflow is installed.
  • Cook Out Restaurant, 2024 Plank Road Fredericksburg, VA 22401
    • Date inspected: Oct. 25
    • Total violations: 12
      • Person in charge was unable to show written procedures for clean-up of vomiting and diarrheal events. A sample procedure was given to the person in charge.
      • Observed a food service worker washing their hands in the 3-compartment sink.
      • Observed a food worker wash their hands without soap before going back to preparing food.
      • Observed the charbroil grill encrusted with debris and carbon build-up.
      • Per discussion with the person in charge food workers use tongs to pick up raw bacon, put them in the hot frying oil to "clean" them, before using the same tongs for cooked foods. Environmental Health Specialist had a thorough discussion with the person in charge about the correct procedures for cleaning utensils between raw and cooked foods. Also, discussed using separate utensils for raw and cooked foods.
      • Observed a large amount of flying insects throughout the kitchen. Person in charge advised they do have Orkin come out at least once a month.
      • Observed the following: 1. light was observed around the back door; 2. gaps around the pipes above the syrup dispensers; 3. gap around the pipe under the handwashing sink by the grills; 4. the drive-thru window is not self-closing.
      • Observed two hanging pest strips full of flying pests by the walk-up window and near a shelving unit near the middle of the kitchen. Neither are over areas with exposed foods.
      • Observed the following: 1. the drip pan of the grill bent and leaning against the wall by the charbroil grill; 2. the prep cooler across from the grills with standing water in the bottom; and 3. a gap in the hood vent filter; 4. shelving throughout the facility was rusty. The person in charge advised he has put in a work order for the cooler and drip pan. Discussed using rust resistant spray paint or similar product on the shelving.
      • Observed the non-food contact surfaces of equipment, including the upsplash of the drink dispenser in both the customer and server areas, heavily soiled.
      • Observed the following in need of repair: 1. grout missing and/or cracked throughout the kitchen area; 2. part of the floor missing in the walk-in cooler; one ceiling tile was out of place between the drive-thru window and the hood vent.
      • Observed food and other debris on floors throughout the facility.
  • Dunkin, 428 Garrisonville Road Stafford, VA 22554
    • Date inspected: Oct. 27
    • Total violations: 1
      • Observed two food employees without beard restraints.
  • Park Ridge Elementary School, 2000 Parkway Blvd. Stafford, VA 22554

      • Observed the can opener soiled. Item removed to 3-compartment sink for cleaning.
  • Kiddie Academy of Stafford, 473 Garrisonville Road Stafford, VA 22556

      • Observed no paper towels at the hand wash sink (next to 3-comp sink). PIC placed paper towels at the hand sink.
  • North Stafford High School, 839 Garrisonville Road Stafford, VA 22554

      • The floors underneath the equipment need cleaning.
  • Hard Times Café, 5099D Jefferson Davis Highway Fredericksburg, VA 22408
    • Date inspected: Oct. 30
    • Total violations: 15
      • Observed the Handwashing sink at the cook line was blocked with a trash can .Trash can was relocated during the inspection.
      • Observed one handsink in the bar area and two handsinks on the cook line without handwashing signage. EHS provided signs to the person in charge.
      • Observed a handwashing sink in the bar area is being used for a dump sink. EHS advised the person in charge to remove the soap and paper towels and use as a dump sink only since there is another handsink near by.
      • Observed the interior of the bulk ice machine soiled with pink and black growth.
      • Observed the potato slicer heavy soiled.
      • Observed the following foods that were made in house in the walk-in cooler that were held pass the seven day requirement: 1.BBQ pork made 10/20 (ten containers ) 2. Buttermilk ranch 10/21 ( one large container) 3.Texas chili 10/21(one large container ) The person in charge voluntary discarded all foods during the inspection.
      • Per discussion with the person in charge, the facility currently vacuum seals ribs. The process the facility is as follows: ribs get cooked, cooled, vacuum sealed, frozen, thawed in cooler and used within 4 days time. Discussed the required (without a variance) steps for vacuum sealing with the person in charge.
      • Observed the following equipment in poor repair: 1. all metal shelving throughout the facility is HEAVILY rusted 2. one deep freezer with the interior of the lid coming undone (insulation was observed) 3. ice build up in all deep freezers 4. accumulation of water in one of the glass coolers in the bar area-heavy rust was observed in the bottom surface of the cooler.
      • Observed the following nonfood contact surfaces in need of cleaning: 1. Speed rack 2. Interior of fryer cabinets 3. Interior of oven 4. Exterior of stove.
      • Observed several sheet pans and frying pan on the non food contact surface heavily encrusted with debris.
      • Observed ceiling tiles including air vents throughout the facility require immediate cleaning especially over the cook line.
      • Observed the following facilities in poor repair: 1. cracked and missing floor tiles in the dry storage area 2. a hole in the wall next to a dump sink in the smoking/bar area 3. in the service station next to cook line the counter top backsplash is damaged 4. a hole in the wall behind a handsink in the smoking/bar area 5. several loose ceiling tiles throughout the facility 6. tiles at the cook line are damaged and have holes.
      • Observed the ceiling tiles in the smoking bar area are porous and smooth and easily cleanable.
      • Observed the hood system dripping with grease.
      • Observed employee belongings (baseball cap, water bottle, vapes, keys, cell phone) stored on the same shelf as clean equipment and dried foods. During the inspection the employee belongings were relocated.
  • Dunkin Donuts, 3730 Plank Road Fredericksburg, VA 22407
    • Date inspected: Oct. 30
    • Total violations: 5
      • Observed a food employee touch their head, with gloves on, and then go pick up a bagel for a customer. After discussion with the employee they voluntarily discarded the bagel and gloves. Then the employee washed their hands and put on new gloves before getting a new bagel for the customer.
      • Observed the following holding at improper temperatures in the reach-in cooler 1-door under the drink machines: 1. opened almond milk 50 degrees F; 2. opened coconut milk at 45 degrees F; and 3. opened soy milk at 43 degrees F. The internal temperature of each was measured, and the unit was at 48 degrees F. The items had been in opened for less than 4 hours, so they were relocated, and the unit was turned down. The person in charge will keep all TCS foods out of the unit until the unit is holding below 41 degrees F.
      • Observed the back door and the drive-thru window are not self-closing.
      • Observed several food employees with their hair hanging in their face under the visor, and hanging over the visor that they were wearing as a hair restraint. Ensure that hair is completely restrained so that it won't contaminate food or single-service articles.
      • Observed the 3-compartment sink, women's restroom hand sink, men's restroom hand sink, and the hand washing sink near the registers, with some areas of the caulking missing.
  • Lafayette Upper Elementary School, 3 Learning Lane Fredericksburg, VA 22401
    • Date inspected: Oct. 30
    • Total violations: 1
      • Observed the inside of the ice machine soiled.
  • Long John Silver's, 5167 Plank Rd Fredericksburg, VA 22407
    • Date inspected: Oct. 31
    • Total violations: 2
      • Observed Quaternary Ammonium sanitizer in the 3 vat sink at 0 ppm. Solution was drained during the inspection.
      • Observed the mop sink with a long hose and sprayer attached without a dual check valve, atmospheric backflow preventer is connected to the faucet. During the inspection the operator removed the spray nozzle. Informed the operator the spray nozzle is not permitted to be used and connected to the hose until the appropriate backflow preventer (dual check valve with atmospheric vent) is installed.
  • Red Lobster #0572, 3109 Spotsylvania Mall Drive Fredericksburg, VA 22407
    • Date inspected: Oct. 31
    • Total violations: 1
      • Observed long hose with spray nozzle connected to the water line by the dishwasher and long hose connected to a power washer connected to a Y-connector at the mop sink in absence of adequate backflow prevention (dual check valve with atmospheric vent). Advised the operator to disconnect the hose by the dishwasher but could not be completed due to difficulty in removal. Instructed the operator to discontinue use until adequate backflow prevention is installed.
  • Taco Bell #1879, 543 Emancipation Hwy Fredericksburg, VA 22401
    • Date inspected: Oct. 31
    • Total violations: 4
      • Observed a food employee wet a wiping cloth at the kitchen handsink. EHS discussed the observation with the person in charge. Person in charge will discuss with employees.
      • The following non food contact surfaces require cleaning: 1. work tables on both sides of the fryers 2. upsplash of the lobby soda machine 3. bottom shelves in the walk in cooler.
      • Observed floor drains in need of cleaning, some ceiling tiles stained, floors behind the fryers and equipment in the cook line.
      • Observed the following in need of repair: 1. several loose ceiling tiles in front of the walk in cooler door 2. one missing floor tile near the basin of the mop sink 3. peeling ceiling tiles above the 3 compartment sink.
