Fredericksburg Health Inspections: Bojangles, El Patron, Taste Of Spice, Pollito Chicken

The Rappahannock Area Health District recorded several violations at facilities around the Fredericksburg area during recent inspections.

FREDERICKSBURG, VA — The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg, Stafford, and Spotsylvania during recent inspections. The most recently published inspections occurred between June 22 and June 28.

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

  • Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

  • Arby's, 418 Garrisonville Rd #118 Stafford, VA 22554
    • Date inspected: June 22
    • Total violations: 10
      • Observed that the floors under the equipment require cleaning.
      • Observed the mops not hung up to air dry.
      • Observed the following non-food surfaces that require cleaning: oven mitts, storage shelves under the equipment, cabinets under the fryers, interior of the nacho cheese machine, tops of the floor-mounted equipment, and the beverage tubes.
      • Observed single service containers stored with the food-contact surface facing upwards.
      • Observed the handle for the ice scoop laying directly in the ice. The employee removed the scoop.
      • Observed nacho cheese hot holding at 118'F. The person in charge placed the cheese in the microwave to reheat it.
      • Observed that several stainless pans and the metal knives on the knife rack require cleaning. EHS placed the equipment on the drainboard to the 3-compartment sink for cleaning.
      • Observed that the interior of the microwaves require cleaning.
      • Observed that the hot holding trays and the coffee machine require cleaning.
      • Observed an employee touch his hair and another employee handle soiled equipment without washing their hands before returning to prep foods. EHS discussed this with both employees and the person in charge.
  • Pollito-Chicken, 10420 Courthouse Road Spotsylvania, VA 22553
    • Date inspected: June 23
    • Total violations: 17
      • Person in Charge was not ensuring food employees were properly washing hand; cleaning and sanitizing equipment properly; or aware of allergens and reportable illnesses. All items were discussed with the Person in Charge and proper guidance's were provided.
      • Facility does not have a signed Employee Health Policy available. Person in Charge was provided with an Employee Health Policy that was reviewed and signed by PIC and employees.
      • Observed food employee donning gloves without prior handwash.
      • Observed food employee apply hand soap prior to wetting hands while washing hands at handwashing sink.
      • Observed sink at front service area of food facility with handwashing sign available, but food employees do not utilize sink for handwashing. Person in Charge removed sign to prevent handwashing at sink.
      • Observed yuca being prepped at prep table at 1:30pm and holding at 65F, Person in Charge stated food was brought out of refrigeration 30 minutes prior, at 1:00pm. Person in Charge stated yuca was cooked the day prior, then left in container at ambient temperature for unknown amount of time to cool to 41F. Person in Charge was informed of proper cooling procedures and discarded improperly cooled yuca.
      • Observed food (chicken, potatoes, beans) stored in walk-in refrigerator held for greater than 24 hours not date marked as required.
      • Observed spray bottle in back prep area of food facility not labeled with common name of chemical. Person in Charge labeled bottle.
      • Observed Tres Leches Cake thawing on cart outside of refrigeration, holding at 57F. Person in Charge relocated food to walk-in refrigerator to continue thawing.
      • Person in Charge did not have an available small-probe thermometer at the food facility.
      • Observed in-use utensils stored in water at 75F.
      • Observed single-use containers reused to store soy sauce, msg, and sauce in back prep area of food facility.
      • Observed cutting board stored on shelving in back prep area of food facility to be deeply scored and in need of resurfacing or replacing.
      • Raw, unfinished wood used for rotisserie skewer storage, not a smooth and easily cleanable material.
      • Observed an accumulation of debris and residue build-up on rotisserie skewer storage rack. Observed label residue on nonfood-contact surfaces of cleaned food containers on shelf in back prep area of food facility.
      • Observed leaking from base of wall, opposite of 3-compartment sink. Plumbing is in need of repair.
      • Lighting at cook line observed at 25 foot candles. Observed light bulb not working under ventilation system.
  • Paradise Diner, 260 Warrenton Road Fredericksburg, VA 22405
    • Date inspected: June 23
    • Total violations: 9
      • Observed the following: 1) an uncovered container of cooked mushrooms stored near raw shrimp and fish on the bottom shelf in the second prep unit by the wall. 2) a tray of raw chicken stored over a tray of raw beef in the reach in cooler by the exterior door. Items were re-arranged.
      • Observed the dishmachine not operating properly. The concentration of the chlorine is 0 PPM. EHS instructed PIC to use 3- compartment sink to wash, rinse, and sanitize until the unit is repaired.
      • Observed the following TCS foods stored at room temperature without prior approval from the Health Department for using time as a public health control (TPHC), items were not labeled to track time: pork sausage patties (84'F), pork sausage links (82'F), scrapple (74'F), raw shell eggs (64'F), cooked home fries (68'F). Per discussion with the person in charge, the items are cooked shortly after opening and stored by the grill for easy access. No temperatures were taken throughout the cooling process to ensure proper cooling methods are in place. Per the Virginia Food Regulations, TCS foods have to be held either cold or hot- foods can not be left at room temperature unless the facility was granted permission by the Health Department and required records are in place. EHS discussed TPHC requirements with PIC.
      • Observed four packets of thawed out tilapia fish stored on the top shelf of the second perp unit near the wall. The instructions on the package stated that the product has to be removed from the packet prior to thawing. Fish was discarded.
      • Observed several of the cooling units without temperature measuring devices.
      • Observed the presence of multiple flying insects by the dry storage room.
      • Accumulation of debris was noted on the exterior of fryer, stove, all refrigeration units.
      • The following areas were noted in need of cleaning: 1) wall and floor by the dishmachine area; 2) the walk in cooler and freezer; 3) storage room area in the back of the house.
      • Observed several employees' personal belongings stored next to food and equipment throughout the facility. Items were relocated.
  • Fusion: Caribbean and American Grill, 3925 Richmond Highway Stafford, VA 22554
    • Date inspected: June 23
    • Total violations: 9
      • Facility could not produce an employee health policy.
      • Observed open water bottles and one employee drinking coffee in the kitchen. EHS addressed this with the person in charge.
      • Observed sanitizer bottle being stored in hand washing sink in the bar area. EHS addressed this with the PIC.
      • Observed that there is no hand washing sign at the hand sink in kitchen and the hand sink in the bar area. EHS provided hand washing signs.
      • Observed one bucket of red beans prepared yesterday being held 55 degrees not cooled properly in reach-in cooler. Person in Charge voluntarily discarded the beans.
      • Observed the following items not date marked: 1. Red Beans 2. Rice and Beans 3. Soup
      • Observed two bottles of steramine tablets stored over tea powder. Person in Charge relocated steramine tablets.
      • No test strips available to test quaternary ammonium.
      • Observed the following non food contact surfaces require cleaning: 1. Reach-in coolers 2. Display cases 3. Inside oven 4. Under chargrill (Corrected)
  • Sake Thai & Sushi Bar, 65 Dunn Drive Stafford, VA 22556
    • Date inspected: June 23
    • Total violations: 11
      • No certified food protection manager available.
      • Observed a food employee handle soiled dishes then proceeded to engage in food preparation without first washing their hands. Employee was instructed to wash their hands.
      • No disposable towels were provided a the hand washing sink by the shelving unit and chest freezer.
      • The set up of the 3 compartment sink does not allow for proper sanitization for food contact surfaces. First basin contained soap and water, second basin contained soap, bleach, and water; and third basin contained only water. EHS explained the proper set up- PIC corrected during the inspection.
      • Observed the following: 1) fresh garlic mixed with oil stored on a cart by the cook line for over four hours. Per discussion with the PIC the product is left out all day at room temperature. As per the VA Food Regulations once garlic is mixed with oil it becomes a time/temperature control for safety (TCS) Food and has to be stored at 41'F or below. Product was discarded. 2) one piece of raw fish (63'F) stored in reach in cooler under the sushi display unit in the bar area. Fish was discarded.
      • A date marking system is not in proper use for the prepared ready-to-eat TCS food throughout the facility.
      • Observed several of the cooling units without temperature measuring devices.
      • Observed a container of store bought half and half creamer and plastic pitcher of iced tea stored in the ice machine used for dispensing ice for beverages.
      • Observed clear plastic food containers stacked while wet after sanitizing on the warewashing shelving units near the 3 compartment sink. Discussed requirements with PIC.
      • Observed the sushi cooling unit (59'F VDH thermometer) by the bar in need of repair.
      • Observed the hood system and filters soiled with grime and debris.
  • Cracker Barrel Old Country Store #106, 5200 Southpoint Parkway Fredericksburg, VA 22407
    • Date inspected: June 24
    • Total violations: 6
      • Observed food employee with single-use gloved hands leave and return to the kitchen touch their face and and handle clean dishes while wearing the same gloves.
      • Observed two pans of cooked macaroni noodles prepared on June 23, 2022 at 55 degrees. Person in Charge voluntarily discarded the macaroni noodles.
      • Observed several employees without proper hair restraints working in the kitchen.
      • Observed five spatulas with bent and melted handles. Person in Charge voluntarily discarded the spatulas.
      • Observed the following non food contact surfaces soiled: Ice build-up in reach-in freezer Walk-in cooler condenser unit Top of upright hot and cold holding units
      • Observed the walls and ceiling soiled.
  • El Patron Mexican Restaurant, 9112 Old Battlefield Blvd 112 Spotsylvania Courthouse, VA 22553
    • Date inspected: June 24
    • Total violations: 16
      • Back handwashing sink was observed at 90F, rather than 100F as required. Person in Charge will ensure employees utilize other available handwashing sink until it is working properly.
      • Observed cup stored in front handwashing sink and observed equipment in back handwashing sink. Also observed employee filling container with water at back handwashing sink. Person in Charge was informed that handwashing sinks should only be utilized for handwashing.
      • Observed tortillas above oven at cook line stored uncovered and unprotected. Person in Charge covered food items.
      • Observed food items (shredded beef 50F, shredded chicken 49F, cheese 47F, and milk 48F) held in walk-in refrigerator holding above 41F.
      • Observed spray bottle in warewash area of food facility without label indicating common name of chemicals. Person in Charge labeled spray bottle with common name.
      • Prep unit and both sliding door refrigerators were observed without a temperature measuring device available.
      • Observed 5 flying insects in warewash area of food facility.
      • Observed cutting boards stored to air dry over opened breading at back prep table. Observed water dripping from cutting boards. Person in Charge relocated food items to prevent potential contamination.
      • Observed knives stored in water at 70F on shelf under back prep table.
      • Observed plates and single-use containers stored at prep line uncovered and unprotected. Person in Charge covered equipment to prevent contamination.
      • Cutting boards at back prep area and cutting boards at prep unit and steam table observed to be deeply scored and are in need of resurfacing or replacing.
      • Observed rice and tortillas stored in grocery bags at cook line. Person in Charge discarded food items.
      • Observed 3 rubber spatulas in back prep area that were damaged and no longer in good repair. Person in Charge discarded utensils.
      • Walk-in refrigerator observed holding between 41-50F, not an adequate temperature to ensure food is being held below 41F as required. Person in Charge relocated food holding below 41F and will not use refrigeration until it has been properly repaired. Observed gaskets at prep unit to be damaged and no longer allowing for proper seal of door. Walk-in freezer door observed with ice build-up and is not closing properly to seal.
      • The following nonfood-contact surfaces were observed with an accumulation of debris and residue and are in need of cleaning: shelf above stove, and cart in back prep area (Corrected on Site).
      • Observed personal jacket, hat, backpack, and apron stored on bagged tortillas and boxes of canned food items in back storage area of food facility. Person in Charge relocated personal items to designated area.
  • Children of America Salem Church, LLC, 12008 Old Salem Church Road Fredericksburg, VA 22407
    • Date inspected: June 24
    • Total violations: 6
      • Facility does not have a person that is a Certified Food Protection Manager. Because of recent changes in management, person in charge was not aware a CFPM was needed.
      • Person in charge was unable to provide an employee health policy. During the inspection EHS provided a copy and employees read and signed the policy.
      • Observed a food employee prepare canned oranges using the handsink. EHS explained to food employee proper use of handwashing sinks. During the food employee removed the container of food from the handsink.
      • Person in charge was unable to provide a test kit for the sanitizer being used in the facility.
      • Observed the following non food contact surfaces in need of cleaning: 1. Drawers/Cabinets holding utensils 2. Inside surfaces and racks of the reach in cooler 3. Vent above cabinets is dusty.
      • Observed a water leak under the 3 compartment sink. Person in charge stated a work order has been placed.

      • Facility does not have an available signed Employee Health Policy. Person in Charge was provided with Employee Health Policy.
      • Paper towels were not available at handwashing sink. Person in Charge refilled paper towel dispenser.
      • Observed soap dispenser and paper towel dispenser located at 3-compartment sink.
      • Observed spray bottle, stored near prep area, without label indicating common name of the chemical. Person in Charge labeled spray bottle.

      • Observed non-TCS food contact surfaces (juice dispenser nozzles, ice dispenser tube, and sugar dispensers at front drive-thru area and ice machine in back area of food facility) with an accumulation of debris and residue and are in need of cleaning.
      • Observed food employees in prep area of food facility not wearing proper hair restraints as required, such as hats or hair nets.

      • Observed presence of small crawling insects and rodent droppings on a covered container of grits in the dry storage area. During the inspection the person in charge voluntarily discarded the container for safety. The person in charge reported pest control was at the facility the morning of 6/27/2022.

      • Observed food employee leave food prep area and go into walk-in cooler and when they returned not wash their hands before changing gloves.
      • Observed that there is no hot water in the kitchen handwashing sinks.
      • Observed Person in Charge does not have shell stock ID tags.
      • Observed the following: 1. Crab rolls stacked on top on cilantro in food prep unit. 2. 3 pans in 3 buckets of lettuce. 3. Uncovered soups cups with onions stacked in reach-in cooler.
      • Observed two microwaves in the kitchen soiled.
      • Observed container of soiled utensils stored with clean utensils in an uncovered plastic container.
      • Observed inside of ice machine soiled.
      • Observed sushi rice being held without time written down for when to discard.
      • Observed a bottle of Dayquil stored in kitchen with utensils.
      • Observed that food thermometers were not present in the facility.
      • Observed small flies throughout the kitchen.
      • Observed single use containers being used in sauces and soups.
      • Observed the following equipment soiled: 1. Inside of oven 2. Reach-in coolers across from flattop 3. Walk-in cooler floor 4. Walk-in freezer floor 5. Walk-in Condenser Unit.

    • Date inspected: June 28
    • Total violations: 15
      • Person in Charge was not ensuring proper handwashing and glove use procedures for food employees; no barehand contact with ready-to-eat food products; and food is held at proper temperatures.
      • Observed food employee donning gloves without prior hand wash. Food employee was informed to wash hands prior to donning gloves.
      • Observed food employee washing hands at 3-compartment sink, rather than handwashing sink as required. Food employee was informed and directed to wash hands at handwashing sink.
      • Observed food employees touching cilantro, which is to be used for garnish, with bare hands. Cilantro that was touched was discarded.
      • Observed pans stored in back handwashing sink, not allowing access by employees to wash hands.
      • Dough machine in back prep area of food facility, observed with an accumulation of debris and residue and is in need of cleaning.
      • Observed tomato sauce stored hot holding on stove top, holding at 108F, rather than 135F or higher as required. Person in Charge reheated food to 204F.
      • Observed butter, a temperature control for safety food, was stored on shelf next to cook line holding at 75F for unknown amount of time. Person in Charge discarded food product.
      • Observed food container stored on shelving next to 3-compartment sink stored wet in a manner that does not allow for draining and/or air drying (wet nesting).
      • Observed spices and cornstarch stored in single-use containers on shelf next to cook line. Observed spices stored in single-use containers on shelf above prep counter. Person in Charge relocated food products to food containers.
      • Observed cutting boards stored throughout kitchen that were deeply scored and are in need of resurfacing or replacing.
      • Observed cardboard lining shelves in kitchen area of food facility.
      • Observed poultry and lamb products stored in grocery bags in walk-in freezer. Observed cilantro stored on cardboard for preparation at prep table in kitchen area of the food facility. Person in Charge discarded food that was in contact with surfaces that were not smooth and easily cleanable.
      • Observed banded brush used for food surfaces stored at cook line.
      • Observed an accumulation of static dust on hood baffles at ventilation system above cook line.
  • Hilton Garden Inn Fredericksburg, 1060 Hospitality Lane Fredericksburg, VA 22401
    • Date inspected: June 28
    • Total violations: 12
      • Observed no employee health policy in facility. Person in Charge and employees signed new policy.
      • Observed that the handwashing sink near walk-in units was missing hand soap. Person in Charge replaced hand soap.
      • Observed that the hand washing sink near walk-in coolers missing paper towels. Person in Charge replaced paper towels.
      • Observed that there was no sanitizer being pulled through tubing for 3 compartment sink. Person in Charge replaced sanitizer and manually poured it into 3 compartment sink.
      • Observed 4 individual containers of vanilla yogurt expired in self serve area.
      • Observed that the facility does not have a consumer advisory for steak and eggs. Person in Charge updated menu with the consumer advisory.
      • Observed 5 individual vacuum sealed packs of salmon improperly thawed in walk-in cooler. Person in Charge voluntarily discarded the salmon.
      • Observed multiple food storage containers being stacked and stored without being allowed to completely dry.
      • Observed test strips for quaternary ammonium sanitizer is missing.
      • Observed the following non-food contact surfaces soiled: Ice Machine (Corrected), reach-in coolers, 4 door reach-in cooler.
      • Observed the floors in food prep area are soiled. Person in Charge had kitchen floors cleaned.
      • Observed two broken light shields and one missing light shield in the kitchen.

      • The exhaust vent covers in both public restrooms were observed soiled.

    • Date inspected: June 28
    • Total violations: 15
      • The person in charge could not provide written procedures for the clean-up of vomiting and diarrheal events. Sample written procedures were provided during routine inspection on 7/12/2021. Provided handouts to develop written procedures.
      • Observed a food employee use single use disposable gloves to sanitize a surface with Quaternary Ammonium sanitizer, remove gloves and begin to don new gloves to handle cleaned equipment without washing their hands. Also observed another food employee place frozen and raw pork sausages on the flattop grill for cooking, remove gloves and begin to don new gloves without washing their hands. Instructed the food employee to wash their hands. Discussed correct glove use.
      • Observed ice inside the biscuit preparation area handsink basin. Instructed the person in charge handsinks are to be used for handwashing tasks only.
      • Absence of hand drying provision at the chicken prep area handsink. The person in charge reported the batteries were running low. During the inspection the person in charge placed a roll of disposable paper towels on top of the towel dispenser.
      • Observed a food employee use the same single use disposable glove to touch their glasses and handle single use articles. Instructed the food employee to remove gloves and wash their hands.
      • Through discussion with the person in charge the raw chicken breading equipment are cleaned and sanitized once every five hours. The equipment is not held under refrigeration. Instructed the person in charge to clean and sanitize raw chicken breading equipment at least once every four hours. The person in charge agreed to comply.
      • Observed the following: 1- Lighter suspended on a wire rack above a food preparation table and 2- Polish cleaner stored on the top shelf of a wire rack which is being used to store packaged food. During the inspection the toxic materials were relocated to prevent contamination.
      • The following equipment does not have a working or installed ambient air thermometer: Drawer cooler, 2 door reach in freezer and 2 door reach in cooler.
      • Observed the following: 1- Wet wiping cloth stored on top of a prep table and 2- wiping cloth held in wiping cloth bucket in absence of any measurable Quaternary Ammonium sanitizer when tested with a testing kit. During the inspection the wet wiping cloth was placed in a sanitizer bucket and the person in charge discarded the wiping cloth bucket and retitrated to 200 ppm.
      • Observed dispensing utensils stored in a container of water at 128 degrees F on a prep table. Discussed holding utensils in a clean and dry container and remove for cleaning and sanitizing every 4 hours.
      • Observed stacks of stainless steel food storage containers stacked while wet after chemical sanitizing on warewashing area shelving.
      • Observed the following in poor repair: 1- Ice build up inside the 2 door reach in freezer and under the fans in the walk in freezer, 2- rusted shelving in the walk in refrigeration units, and 3- plastic curtains inside the walk in coolers/freezers are damaged.
      • Accumulation of debris was noted on the following nonfood contact surfaces: Shelving under hot holding units, upsplash of coffee brewer, wheels of mobile equipment, interior of 2 door reach in freezer, shelving throughout including inside the walk in refrigeration equipment.
      • The floors under equipment, air vents, ceiling tiles, ceiling light covers, caulking at the front handsink and floor drains are in need of cleaning.
      • Observed 28 foot candles of light at the flattop grill and 18 foot candles of light at the deep fryers. Observed dimmed or blown out shielded lights under the hood and ceiling lights in the vicinity of the cooking equipment.

      • Observed bin with various items stored in back handwashing sink, not allowing sink to be easily accessible to employees at all times. Person in Charge relocated items.
      • Observed an accumulation of residue on can openers blade. Person in Charge brought can opener to 3-compartment sink to be washed and sanitized.
      • Observed personal medication stored on shelf above prep unit in kitchen area of food facility. Person in Charge relocated medicine to prevent contamination.
      • Observed food employees preparing food in kitchen area of food facility without wearing proper hair restraints such as hats or hair nets.
      • Observed kung pao sauce stored in walk-in refrigerator and rice noodles stored in prep unit, stored in containers with single-use lids. Observed single-use can stored in dry rice container, used as scoop. Person in Charge discarded can. (Corrected on Site)

      • Observed an accumulation of trash and debris surrounding dumpster area located outside of food facility.

      • Person in charge was unable to provide an employee health policy. EHS provided a copy and employees acknowledged and signed the policy.
      • Observed no paper towels were available at the handsink of the kitchen. During the inspection the person in charge provided papertowels.
      • Observed no soap was available at the handwashing sink of the kitchen. During the inspection the person in charge provided soap.
      • Observed several trays of foods being stored uncovered in the walk in freezer. During the inspection food trays were covered.

      • Observed the doorway from of the back door is damaged on the bottom right corner.
      • Observed the walls of the kitchen require cleaning.
