Fredericksburg Health Inspections: Children's Playpen In Kitchen

The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent restaurant inspections.

FREDERICKSBURG, VA — Several facilities in the Fredericksburg area recorded violations during recent inspections from the Rappahannock Area Health District. Inspectors conducted the most recent visits between Feb. 1 and Feb. 7.

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

Here are the most recent violations as listed by the Rappahannock Area Health Department:

  • Homespun, 10153 Patriot Hwy Fredericksburg, VA 22407
    • Date inspected: Feb. 1
    • Total violations: 3
      • Observed ice cream mix and bread dough which is prepared with TCS ingredients (shell eggs) were not dated. The person in charge reported the ice cream mix was prepared on 1/30/23 and dough prepared the day prior. During the inspection the food containers were dated. Discussed date marking requirements.
      • Observed two dented cans being stored with other cans. Instructed the person in charge to designate an area for damaged foods. During the inspection the dented cans were relocated to another shelf.
      • The person in charge could not provide a Quaternary Ammonium sanitizer test kit.
  • J's Pizza & Subs Cafe, 20 Plantation Drive Suite #103 Fredericksburg, VA 22406
    • Date inspected: Feb. 1
    • Total violations: 3
      • No certified food protection manager available.
      • The concentration of the quaternary ammonium sanitizer solution at the 3 compartment sink and the sanitizer bucket to be used on food contact surfaces measured 0 PPM, according to the manufacturer instructions the concentration should be between 150-400 PPM. Sanitizer was made over 6 hours prior to testing- Sanitizer was re-made (300 PPM).
      • Direct connection exists at the 3 compartment sink sewer line. No air gap between the sink sewer line and the grease trap.
  • Merit School of Garrisonville #3, The, 664 Garrisonville Road Stafford, VA 22554
    • Date inspected: Feb. 2
    • Total violations: 3
      • The facility has removed the hand sink from the kitchen.
      • Observed that the blade of the can opener requires cleaning. The person in charge placed the can opener in the 3-compartment sink for cleaning.
      • Observed an open container of pest control devices stored in the chemical cabinet. The person in charge removed the devices.
  • Pancho Villa Mexican Restaurant, 752 Warrenton Road Fredericksburg, VA 22406
    • Date inspected: Feb. 2
    • Total violations: 24
      • Absence of active managerial control observed during the inspection. Employees are not using proper methods to rapidly cool time/temperature control for safety food that is not held hot or is not for consumption within four hours, through daily oversight of the employees' routine monitoring of food temperatures during cooling. Employees are not properly trained in food safety- observed hand washing violations.
      • The person in charge could not provide documentation of employee health training.
      • The food establishment does not have written procedures for cleaning up vomiting or diarrheal events that happen in the facility.
      • Observed the person in charge handle chemicals then touched clean equipment without first washing their hands. PIC was instructed to wash their hands.
      • Improper handwashing procedures observed. Employee washed hands for less than 10 seconds. Observation was discussed with the person in charge.
      • The only handwashing sink in the bar was not supplied with soap. The person in charge placed soap at the sink.
      • Observed absence of hand drying provision at the bar hand washing sink. The person in charge provided disposable paper towels at the sink during the inspection.
      • Observed cooked to order salmon offered on the menu- per discussion with the person in charge the salmon gets cooked to 135’F. The person in charge was unable to provide a parasite destruction letter.
      • Observed the ice machine to be soiled.
      • Observed several pans, containers, and cooking utensils to be soiled to the touch and sight.
      • Observed 4 stainless steel containers of melted cheese (23-128'F) stored at room temperature in the oven. PIC stored items have been there for less than one hour- EHS instructed PIC to reheat the items 165'F (corrected).
      • Observed the following 1) a container of salsa (46'F) stored on the counter for less than 30 minutes over ice- PIC will add more ice (corrected), EHS instructed PIC to add more ice, use time, monitor time, 2) a container that contained tomato sauce and chicken broth (100'F) stored over the convention oven (discarded)- 3) a container of cut tomatoes (43-46'F) stored over ice on a cart in the lobby for less than 2 hours- PIC will add more ice (corrected).
      • Facility is using time as public health control without proper procedures and records in place. Observed an unmarked container of salsa(46'F) and a container of cut tomatoes (43-46'F) inadequately stored over a few ice cubes. PIC will provide more ice and discard and will monitor the temperature. EHS discussed Time as a public health control requirements.
      • The disclosure and reminder for the consumer advisory do not meet the Virginia Food Regulations requirements. Observed cooked to order salmon and raw eggs are offered on the menu without an asterisk (*) to serve as a reminder to the disclosure statement. Observed an (*) by the fries and hamburger offered on the children's menu- 2) Children shall not have cooked to order comminuted ground beef.
      • Observed an unlabeled spray bottle that contained chemicals stored behind the oven. Item was labeled and relocated.
      • Covered containers of food are being stored under leaking water lines inside the walk in cooler. The facility has placed a large container under the leak to prevent contamination, which was observed nearly full. Instructed the person in charge to relocate the food to prevent contamination and discontinue food storage in this area until repairs are completed.
      • Employees observed working in the food service area without proper hair restraints.
      • Spices containers are being re-used to store other food items.
      • Observed the following 1) paper towel holder at the hand washing sink located in the kitchen is broken, 2) several shelving units throughout the facility are rusted.
      • Accumulation of debris observed on the non food contact surface of the interior of the reach in refrigeration units, soiled shelving units, and fryers cabinets.
      • Observed a hose attached to a Y connector with a sprayer at the mop sink without an air gap. An adequate back flow prevention device is needed for continuous use.
      • Observed numerous blown out ceiling lights throughout the facility and and ceiling light cover by the dry storage room is not secured to the frame and is hanging which presents a safety risk, the 3 compartment sink and the hand washing sink in the kitchen need to be re-caulked.
      • The floors, walls, ceiling light covers throughout the facility, and the 3 compartment sink and dishmachine area are in need of cleaning.
      • Observed several employees' personal belongings stored near food and equipment. Items were relocated.
  • Firehouse Subs, 1036 Warrenton Road #103, Fredericksburg, VA 22406
    • Date inspected: Feb. 3
    • Total violations: 9
      • Observed an employee handle chemicals and soiled dishes then applied gloves without first washing their hands. Employee was instructed to wash their hands.
      • Observed the interior of the microwave oven to be soiled.
      • Through discussion with the person in charge the knives used to cut sandwiches that contain time/temperature control for safety foods, are removed for cleaning every at the end of the shift (more than 5 hours). Informed the person in charge equipment in contact with TCS foods are required to be cleaned and sanitized at least once every 4 hours.
      • Observed commercially processed chili (44' F) cold holding at improper temperature in the prep unit. The item was placed in the unit for over 4 hours. The person in charge (PIC) voluntarily discarded the item for safety.
      • Observed an unlabeled spray bottle stored by the handwashing sink- the bottle contained quaternary ammonium sanitizer solution. Bottle was labeled during the inspection.
      • Observed two reach in coolers without temperature measuring devices.
      • Observed several wet wiping cloths stored on the counter.
      • Observed accumulation of debris on the nonfood contact surfaces of the interior and exterior of the refrigeration units and the wire shelving units.
      • Observed the floors throughout the facility in need cleaning.
  • Bo's Cafe, 10392 James Madison Parkway King George, VA 22485
    • Date inspected: Feb. 3
    • Total violations: 9
      • Evidence of a child in the kitchen wad discovered during inspection. Observed children's and a child's playpen set up in the kitchen. Toys and playpen were removed from the kitchen.
      • This food establishment does not have an employee, with management and supervisory responsibility, that is a Certified Food Protection Manager.
      • Observed an uncovered cup of coffee on the cutting board of the prep unit. Drink was removed during inspection.
      • There was no paper towel ta the the kitchen hand sink. Paper towel was provided during inspection.
      • Observed melon with mold on the interior of a cut portion. Melon was discarded during inspection.
      • Observed several cartons of raw shell eggs stored over bread in the walk in cooler. Eggs were relocated during inspection.
      • Observed the following expired ready-to-eat (RTE) foods in the walk in cooler: potato salad (Nov 29, 2022), orange juice (Nov 29, 2022, Jan 3, 2023, May 15, 2022, Jan 10, 2023). Foods were voluntarily discarded during inspection.
      • Observed a can of disinfectant spray and a can of furniture polish stored on top of the reach in freezer next to food storage containers. The chemicals were removed during inspection.
      • Observed children's toys and a cell phone stored on the food contact surface of the meat/cheese slicer. Items were removed during inspection.
  • BJ's Restaurants and Brewhouse, 1861 Carl D. Silver Parkway Fredericksburg, VA 22401
    • Date inspected: Feb. 3
    • Total violations: 10
      • Person in charge was unable to provide an employee health policy. During the inspection EHS provided a copy. PIC reviewed and had employees signed the policy.
      • Observe a food employee touch their face, attempt to put on a new pair of gloves without handwashing. Person in charge instructed employee to wash their hands.
      • Observed the women's bathroom was missing a handwashing sign. During the inspection EHS provided a handwashing sign.
      • Observed the interior and upper surfaces of the ice machine soiled with black mold like staining and growth.
      • Observed a food employee attempt to sanitize a knife by submerging the knife in the sanitizer at the 3 compartment sink for less than 5 seconds. EHS discussed with the food employee and person in charge to ensure clean equipment is making contact with the sanitizer for the sufficient and required time for proper sanitization- 60 seconds for the sanitizer used in the facility. Food employee re-sanitized the knife for the required time.
      • Observed food employees working without proper hair restraints.
      • Observed the following non food contact surfaces that require cleaning: 1. handles of equipment throughout the kitchen 2. interior surfaces of the upright freezer in the kitchen 3. shelving used to hold clean equipment and dried foods throughout the kitchen 4. inside fryer cabinet and outside surfaces of fryers.
      • Observed pizza pans and other cooking equipment that have a heavy build up and accumulation of debris. Equipment no longer appears cleanable.
      • Observed a backflow prevention device missing from the mop sink. During the inspection EHS observed a long hose on the ground of the mip sink, attached to the faucet of the mop sink, hose was not under water pressure at the time. Person in charge hung up the nozzle of the hose during the inspection.
      • Observed the following areas in need of cleaning: 1.floors underneath equipment, especially around fryer area 2.walls behind equipment at the cook line 3.floor drains throughout the kitchen mop basin 4.caulking need recaulking or deep cleaning 5.ac vents and some soiled ceiling tiles 6. fan vents in walk in cooler.
  • Stafford Hospital, 101 Hospital Center Blvd. Stafford, VA 22554
    • Date inspected: Feb. 3
    • Total violations: 3
      • Observed the following to be soiled to the touch and sight: 1) three cups stored on a tray near the coffee maker, 2) two bowls located under the hot holding station by the cookline, 3) two stainless steel containers located on the shelving unit used for clean dishes near the dish machine room.
      • Observed the following hot holding at improper temperatures for less than two hours. 1) one grilled chicken sandwich (117'F) in hot holding unit in the front of the house (sandwich was discarded, per facility's policy to discard every two hours). 2) two trays of cooked beef and three trays of mashed potatoes stored in the hot holding unit in the back of the house by the grill= PIC stated the unit was not turned on properly to maintain the required temperature of 135'F or above- Items were stored in the unit for less than one hour- PIC reheated the items to 165'F (EHS verified temperature) and placed in the unit after turning it on properly.
      • Observed the following cold holding at improper temperature for two and a half hours: 1) a container of pasteurized cooked diced boiled eggs (46-47'F),2) a container of salad that contains cut lettuce and cut tomatoes (44-45'F), 3) a container of cut chicken (145'F)- items were discarded per facility's policy.
  • China Garden, 17010 Dahlgren Rd #3 King George, VA 22485
    • Date inspected: Feb. 3
    • Total violations: 5
      • The interior of the microwave and toaster oven was observed soiled. Both were cleaned during inspection.
      • The cutting boards along the prep units were observed stained. Boards were takes to the 3 compartment sink to be cleaned.
      • The following non-food contact food surfaces were observed soiled; 1-the top shelf of the expo station, 2-the outer surfaces of all the equipment on the cook's line, 3-inside of the deep fryer cabinets, 4-outer surfaces of the microwave and toaster ovens, 5-outer surfaces of the bulk food bins, 6-the shelves under the expo station.
      • The walls in the men's restroom are not cleaned as often as necessary to keep them clean. Observed that the walls and the door in the men's restroom is in need of cleaning.
      • The filters in the ventilation hoods over the cook's line are heavily soiled with grime and grease.
  • El Rinconcito Bar Restaurant, 10615 Spotsylvania Ave. Fredericksburg, VA 22408
    • Date inspected: Feb. 3
    • Total violations: 2
      • Facility does not have a certified food protection manager.
      • Observed that the only hand sink in the kitchen is broken. Employees are washing their hands in the prep sink. EHS discussed this with the person in charge.
  • Domino's Pizza #4274, 556 Garrisonville Road Suite #100 Stafford, VA 22554
    • Date inspected: Feb. 6
    • Total violations: 10
      • Observed the interior of the numerous pizza pans require cleaning.
      • Observed that the containers of pizza sauce did not have the times that they were removed from temperature control. The person in charge placed a time on the containers.
      • Observed mice droppings near the liter coke/sprite bottles in the rear storage area.
      • Observed an open mouse bait station under the sprite/coke storage rack.
      • Observed a large amount of pizza pans that were stacked wet.
      • The following non-food contact surfaces require cleaning: all the sauce bottles, tops of the tongs, tops of the wire whisk, and keyboard near the hand sink is encrusted with debris.
      • Observed a sprayer nozzle attached to a hose on the mop sink without a backflow prevention device installed on it.
      • The entire facility is in need of detailed cleaning to include: floors under the storage shelves, floor/wall junctures throughout the facility, ceiling tiles near the pizza oven, wall near the rear prep table, walls behind the hot holding units, drain pipes under the 3-compartment sink, and the air vent cover near the pizza oven.
      • Observed that the wall near the hot holding unit is in disrepair and several wall tiles are missing.
      • Observed that the lights in the restroom are not shielded.
  • Sammy T's, 801 Caroline Street Fredericksburg, VA 22401
    • Date inspected: Feb. 6
    • Total violations: 2
      • Observed floors underneath equipment and walls behind cook/prep equipment that require cleaning.
      • The following facilities were observed in need of repair: 1. Caulking at handsink in the handicap bathroom 2. In the handicap bathroom, an opening along the wall and celing was observed, wall insulation is visible 3. In the back prep room, cracked paint was observed in the center of the room 4.Floors in the prep room and walk in cooler could be resealed 5. Coving needs replacing or resealing on one of the walls in the dishroom 6. The transition floor piece between dish room and hallway is missing 7. Patches of paint missing on the wall of the hallway (by dishroom) 8. A hole observed in the prep room wall behind the meat slicer 9. Some floor grouting missing in kitchen, in front of walk in cooler.
  • Majestic Restaurant Bar & Grill, 3987 Richmond Highway Stafford, VA 22554
    • Date inspected: Feb. 7
    • Total violations: 1
      • Cooked to order steak, hamburgers, and eggs are offered on the menu without a proper consumer advisory disclosure. Items did not have an asterisk (*) to serve as a reminder to the disclosure statement.
  • Arby's #1519, 164 Warrenton Road Fredericksburg, VA 22405
    • Date inspected: Feb. 7
    • Total violations: 2
      • Observed vanilla shake mixture in the shake machine (48'F) cold holding at improper temperatures. The person in charge instructed a food employee to drain the shake machine. Instructed the person in charge to discontinue the use of the machine and contact a technician for service.
      • Observed the milk shake machine not maintaining the required minimum cold holding temperature of 41'F or below (milk shake 48'F). PIC contacted a technician.
  • Dunkin, 150 Warrenton Road Fredericksburg, VA 22405
    • Date inspected: Feb. 7
    • Total violations: 8
      • The person in charge could not provide verification employees have been trained on the employee health policy. Sample policy was posted on the wall and the person in charge was knowledgeable of health reporting symptoms and illnesses. Sample employee health policy was provided to the operator.
      • Observed a food employee chewing gum while preparing customer beverages. Discussed the issue with the person in charge and the employee was instructed to discard the chewing gum.
      • Through discussion with the person in charge the espresso machine wands are removed for cleaning and sanitizing twice a day and blenders in contact with dairy beverages are cleaned every 5-6 hours. The facility is open for over 12 hours. Instructed the person in charge to remove the wands and blenders for cleaning and sanitizing at least once every four hours.
      • Observed large container of cream cheese (43 degrees F) cold holding at improper temperatures inside the prep cooler. Observed the container protruding above the refrigeration well. A food employee reported the cream cheese was removed from the walk in cooler at 8:00 a.m., temperature was observed at 9:06 a.m. Instructed the person in charge to cool to 41 degrees F or less, sell or discard by 12:00 p.m. Discussed placing cream cheese in a smaller container in the future.
      • Observed 3 chemical spray bottles suspended on wire shelving over unprotected single use articles (sweetener packets, packaged coffee). During the inspection the spray bottles were relocated to prevent contamination.
      • Observed employees preparing beverages without proper hair restraints.
      • Observed accumulation of grime and debris on nonfood contact surfaces throughout the facility including the shelving, beverage and sweetener dispensing equipment, interior of convection ovens, round vent above the ovens near the hot holding unit, and floors of walk in freezer.
      • Observed the floors, ceilings and air vents throughout the facility and the plumbing under the 3 compartment sink in need of cleaning.
  • Pizza Bono, 10426 James Madison Parkway King George, VA 22485
    • Date inspected: Feb. 7
    • Total violations: 5
      • This food establishment does not have an employee, with management and supervisory responsibility, that is a Certified Food Protection Manager.
      • An exterior door is not self-closing and tight-fitting. This may allow the entry of insects or rodents.
      • The nonfood-contact surfaces of the following equipment were observed soiled with an accumulation of dust, dirt, food residue, and/or other debris:interior of the deep fryer cabinets, the inside of the reach in freezers, the outer surfaces of the condiment squeeze bottles in the walk in cooler.
      • Toilet room door is not provided with a self-closing door.
      • There is no cover to the feminine napkin refuse container in the ladies room stall.
  • KinderCare Learning Center, 29 Greenspring Drive Stafford, VA 22554
    • Date inspected: Feb. 7
    • Total violations: 2
      • Observed three cooked commercially processed sealed bags of macaroni and cheese (63-70'F) in the rinse basin of the 3 compartment sink- per discussion with the food employee, macaroni and cheese was taken out of the freezer and stored in the reach in cooler overnight to thaw- then took them out 30 minutes prior to the inspection and left them in standing water, there was not water in the basin during the time of the inspection.
      • The nonfood contact surfaces of the interior of the homestyle refrigerator, oven, shelving unit, and cabinet drawers are noted with an accumulation of grime and debris.
