Fredericksburg Health Inspections: Waffle House, Sam's Pizza, F.O.E.
The Rappahannock Area Health District recorded violations at several restaurants, food trucks, and hotels around the Fredericksburg area.
FREDERICKSBURG, VA — The Rappahannock Area Health District recorded violations at several facilities around the Fredericksburg area during recent restaurant inspections. The most recently published inspections occurred between June 8 and June 14.
In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

- Waffle House #1011, 580 Warrenton Road Fredericksburg, VA 22406
- Date inspected: June 8
- Total violations: 19
- Observed absence of active managerial control during the inspection. The person in charge is not monitoring temperatures of TCS foods during cold holding, improper handwashing and glove use observed and equipment in contact with TCS foods are not being cleaned and sanitized at the correct frequency. Discussed monitoring of TCS foods during cold holding and correct glove use and handwashing procedures.
- The person in charge could not provide documentation of employee health training but was knowledgeable of health reporting requirements. Provided sample policy during the inspection to train employees.
- Observed an uncovered beverage on open wire shelving in the dry storage area which is used to store packaged food. During the inspection the person in charge discarded the beverage.
- Observed a food employee touch their hair with their bare hands and then proceed to handle clean and sanitized equipment from the high temperature dishwasher without washing their hands first. Contamination was prevented through instructing the employee to wash their hands.
- Observed a food employee wash their hands for 5 seconds at the front handsink. Instructed the food employee to wash their hands for at least 10 seconds.
- Observed a food employee fill a stainless steel container at the front handsink. Instructed the employee handsinks are to be used for handwashing tasks only.
- Observed the following: 1- Food employee crack a shell egg to be cooked, using single use disposable gloves, and then proceed to use the same gloves to handle equipment, instructed the employee to remove gloves and wash their hands. 2- Observed the same employee place raw bacon on the flattop wear single use disposable gloves and then proceed to handle cleaned equipment without removing gloves and washing their hands. Instructed the food employee to remove gloves and wash their hands. Discussed correct glove use and handwashing with the employee and person in charge. The employee was argumentative during the inspection.
- Through conversation with the person in charge the food establishment is washing and sanitizing the mounted mixer used to prepare omlettes once every 7 hours. Instructed the person in charge to wash and sanitize this equipment at least once every 4 hours.
- Observed interior of the ice machine soiled.
- Observed the following TCS foods cold holding at improper temperatures: 1- 3 door upright cooler - Single service containers of half and half creamer (44, 45 degrees F), chocolate milk (43 degrees F) and milk (44 degrees F). The person in charge reported the TCS were in the unit overnight and voluntarily discarded for service. 2- Prep cooler- Diced ham (53, 52 degrees F), cut lettuce (57 degrees F) and sliced cheese (51 degrees F). The person in charge could not verify how long the TCS foods have been in the unit and voluntarily discarded for safety. Observed water at the base of the unit. The facility will use time as a public health control until the units are repaired, requirements were discussed during the inspection. Also discussed placing small portions on ice in food grade bags to and monitor temperatures every 2-3 hours.
- The facility is using time as a public health control (4 hours) and the container of eggs stored on a shelf above the cook line were not marked to identify the discard time. The person in charge reported the eggs were pulled from refrigeration equipment at 8:00 a.m. and placed a note to discard the eggs at 12:00 p.m. Observed the eggs discarded or used by 12:00 p.m.
- Observed employees wearing wrist jewelry working in the kitchen.
- Observed male employees in the kitchen without proper beard restraints
- Observed coffee filters stored at beverage station with the food contact surface facing upward and absence of overhead protection. During the inspection the top coffee filter was inverted.
- Observed rusted shelving inside reach in refrigeration units.
- The person in charge could not provide a Chlorine test kit to monitor Chlorine sanitizing solutions.
- Accumulation of debris observed on the following nonfood contact surfaces: Interior refrigeration units, upsplash of the coffee brewers, plastic racks used to hold beverage cups, interior of reach in unit under the cook line used to store equipment.
- Observed the door of the right side toilet room is not self-closing.
- Observed cleaning is needed at the following areas: Ceiling tiles, ceiling light covers, air vents in the toilet rooms, floors and walls under and behind cooking equipment and the dishwasher, front handsink.

- The person in charge did not demonstrate Active Managerial Control due to the following actions and/or in actions: 1-no knowledge of food allergens, 2-not maintaining proper cold holding temperatures of potentially hazardous foods, 3-roach and spider infestation in kitchen due to not keeping the kitchen surfaces clean, 4-not date marking foods in the cold holding units.
- The person in charge was unable to provide proof the employees had received training concerning Employee Health.
- The following food item(s) were observed cold holding at improper temperatures in the reach in cooler: pork egg rolls 52'F, sweet and sour chicken 50'F, raw shrimp 55'F, raw chicken wings 45'F. All items were voluntarily discarded during inspection. The walk in cooler's internal temperature was lowered.
- The prepared ready-to-eat (RTE) sweet and sour chicken, egg rolls, cooked noodles, cut cabbage and other items in the refrigeration unit are not date marked. Items were either voluntarily discarded or date marked during inspection.
- Observed live cockroaches crawling on the wok station and on the floor under the equipment on the cook's line. The person in charge made a call to a pest control company during inspection.
- Observed two spatulas stored in water measuring 85 degrees on the wok station. Spatulas were removed during inspection.
- The homestyle reach in freezers, coolers and chest freezer are not installed 6 inches off of the floor.
- The wire shelving in the walk in cooler and near the wok station are rusty and are not able to be cleaned.
- The following non-food contact surfaces are in need of cleaning: 1-the wok station, 2-all shelving (wood and wire) in the kitchen and the walk in cooler, 3-the shelving under the cook's line, 4-the cooling fans throughout the kitchen, the gaskets on all of the cold holding units. IN GENERAL, ALL EQUIPMENT SURFACES IN THE KITCHEN ARE IN NEED OF A THOROUGH CLEANING.
- The following physical facilities are not cleaned as often as necessary to keep them clean: 1-the floors in the kitchen (especially under and behind the equipment), 2-the walls in the kitchen, 3-the ceilings in the kitchen. IN GENERAL ALL PHYSICAL SURFACES IN THE FACILITY ARE IN NEED OF A DEEP CLEANING.
- The light intensity is below 50 foot candles where a food employee is working with food. Observed 4 foot candles on the wok station and 8 foot candles at the prep table.
- The filters in the hood system and the hoods themselves are dripping with grease.
- Subway of Doc Stone, 309 Worth Ave Suite 109 Stafford, VA 22554

- Observed absence of measurable Quaternary Ammonium sanitizing solution in the 3 compartment sink, when measured with testing kit, which was actively sanitizing food contact equipment. The 3 compartment sink was drained and retitrated with the same results. Worked with the person in charge to manually titrate to 300 ppm and 80 degrees F. Instructed the person in charge to contact a technician to service the sanitizer dispenser and ensure manually titrated sanitizer is measured with the testing kit. The food contact equipment was removed to be cleaned and sanitized.
- Observed precooked sliced chicken (46 degrees F) cold holding at improper temperatures in prep cooler #1. The person in charge reported the TCS food has been in the unit since 12:00 p.m. and temperature was observed at 3:13 p.m. The food was removed to the walk in freezer to cool to 41 degrees F or less by 4:00 p.m. Contact technician for service/repair and monitor internal temperatures of TCS foods every 3 hours until the unit is evaluated by a technician.

- Total violations: 6
- Employee was unable to provide documentation of training relating to the employee health policy. EHS provided an employee health policy sample to be signed by all employees and kept on site.
- Observed the hand washing sink in the front of the house being used as a dump sink. Employees were dumping drinks in it. Discussed handwashing sink usage limitations.
- Observed dairy products cold holding at improper temperatures in two Sureshot dispensing units. first unit by the hot coffee machine: 1) whole milk (46'F), second unit by the iced coffee machine: 2) whole milk (44'F), perishable creamer (45'F). According to the cold holding log sheet, milk was recorded above 41'F at three different times throughout the day. Items were discarded, discontinue the use of the unit until evaluated by a technician.
- Observed no temperature measuring devices in two of the cold holding Trueshot dispensing units used to store milk and perishable creamer.
- Observed two containers of croissants stored on the shelving unit, located by the icemachine and the walk-in-cooler. Containers were relocated.
- Observed two Sureshot dispensing units being used to store milk and dairy creamer for drinks in need of repair.
- Sam’s Pizza, 432 Garrisonville Road Suite 103 Stafford, VA 22554

- Total violations: 19
- Observed uncovered employees drinks stored on the prep tables throughout the kitchen. The person in charge had the employees cover their drinks and place them on the bottom shelf of the prep tables.
- Observed one employee pick up a dirty glove off the floor with his gloved hand then attempted to prep foods without removing his gloves and washing his hands and observed another employee leave the prep line with his gloves on, go into the walk in cooler, then return to the prep line and continued to prepare foods without removing his gloves and washing his hands. The person in charge and EHS instructed the employees to remove the gloves and wash their hands.
- Observed the cook handle sub rolls with his bare hands. EHS addressed this with the person in charge.
- Observed uncovered foods in the drop in freezer and uncovered parmesan in the coke display case.
- Observed that the microwaves require cleaning.
- Observed ceramic plates and bowls that were stored dirty to sight and touch across from the hand sink.
- Observed an extra large stock pot of meat sauce that measured 45'F in the walk in cooler. The sauce was made yesterday approximately 6 pm. EHS requested that the product be discarded.
- Observed sliced deli meats, crab soup, and cooked pastas that were not dated.
- Observed chemical spray bottles hanging over the 3-compartment sink that were not labeled. The person in charge labeled the bottles.
- Observed an extra large stock pot of meat sauce cooling in the walk in cooler.
- Observed sunlight coming from under the rear door which leads to the walk in cooler.
- Observed the cook preparing foods with a jewelry on his wrist.
- Observed single service foil pasta dishes and ceramic dishes stored with the food-contact surfacing upwards.
- Observed ceramic plates, hand sink in the employee's restroom, and ceramic dishes that were broken.
- Observed that the doors to the dish machine require cleaning
- Observed that the following non-food contact surfaces require cleaning: all of the storage shelves, inside of the ice cream box,

- Person in charge was unable to provide a verifiable way that employees had been trained on foodborne illnesses and symptoms. EHS provided a copy, food employees signed the policy after reading it.
- Observed no paper towels were available at one of the hand sinks in the facility. Person in charge provided paper towels.
- Observed the absence of handwashing signs in the men and womens bathroom of the facility. EHS provided handwashing signs to PIC.
- Observed the cutting board at the prep table has black staining and is heavily scratched and scored.
- Observed the interior surfaces (lip and upper part) of the ice machine had heavy overgrowth of grime, gunk and black mold-like staining.
- Observed no sanitizer (0 ppm) was detected in a wiping cloth bucket. During the inspection the person in charge discarded and refreshed the sanitizer in the wiping cloth.
- Observed food employees wearing wrist jewelry.
- Observed ice build up on the floor of the walk in freezer and heavy condensation on the ceiling of the walk in freezer. EHS advised PIC to move all boxes of food away from the condensation and build up areas to avoid contamination of food.
- Observed the upsplash of all of the coffee/tea brewers in the facility require cleaning.
- Observed womens bathroom does not have a covered trash can or receptacle available.
- Observed floors underneath equipment require cleaning.

- Observed that the yakisoba were dated 6/12 and 6/22 - date marking exceeds the required 7-days dating. The person in charge corrected the dates on the products.

- Observed a piece of drywall that is used in the reach in cooler as a divider, duct tape used to repair a plastic container, and several large plastic buckets where the plastic lids have been used as a cover.

- Observed employees directly contacting ready-to-eat naan with their bare hands.
- The interior surfaces of the ice machine was observed soiled. The machine was cleaned during inspection.
- The interior of the microwaves were observed soiled. Ovens were cleaned during inspection.
- observed one pan of cooked chicken prepared the previous day cold holding in the walk in cooler at 45'F. The person in charge was given examples of how to properly cool foods such as spreading out foods on a sheet pan. Person in charge voluntarily discarded chicken.
- Did not observe any date marking of food in the facility.
- Person in Charge was unable to provide test strips for chlorine sanitizer.

- No handwashing signage was observed at the bar handwashing sink and the handwashing sink by the front prep area of the kitchen.
- Observed raw shell eggs stored over ready-to-eat pre-cooked roast beef in walk-in refrigerator. Roast beef was relocated to prevent contamination.
- Dish machine observed with a rinse surface temperature of 149F, rather than 160F or above as required. Person in Charge will ensure equipment is washed and sanitized at 3-compartment sink until dish machine is working properly.
- Observed partially cooked chicken wings stored in 2-drawer refrigerator and walk-in refrigerator. Facility does not have submitted written procedures approved by the Health Department prior to proceeding with a non-continuous cooking process. Person in Charge discarded partially cooked chicken wings.
- Observed hot dogs stored in 2-drawer refrigerator undated and held greater than 24 hours.
- Observed Italian meats stored in 2-drawer refrigerator dated with a use by date of 6/5, observed in refrigerator on 6/13. Person in Charge discarded food.
- Observed spray bottle of Quaternary Ammonia sanitizer solution stored on shelf with food items (salt, pepper, hot sauce). Spray bottle was relocated to prevent contamination.
- Observed containers of food throughout kitchen and storage area, not labeled with the common name of the food items.
- Observed what appeared to be rodent-like feces on food container lids and on floor in dry storage room of food facility.
- Observed gap under back exit door in kitchen area of food facility. Gap does not protect against the entry of pests within the facility.
- Observed food employees in kitchen area of food facility without proper hair restraints such as hats, hair nets, or beard nets.
- Observed plates and bowls on shelves above prep area of food facility, stored uncovered.
- Observed wash temperature at dishwasher at 149F, rather than 160F or higher as required
- Facility does not have an available temperature measuring device for the dish machine.

- Observed precooked shrimp tempura (45, 47 degrees F) holding at improper temperatures on the top of the prep cooler. Observed the pan overfilled, food was stored above the fill line. The person in charge reported the shrimp was placed in the unit at 11:00 a.m., temperature was taken at approximately 12:20 p.m. During the inspection the person in charge relocated the shrimp to the walk in freezer to cool to 41 degrees F or less by 3:00 p.m. Discontinue overfilling containers used to hold TCS foods during cold holding.

- Observed food ribs at 49F, chicken at 49F, and salad mix 49F, in walk-in refrigerator at 49F. Person in Charge stated the food was put into the walk-in refrigerator yesterday. Person in Charge discarded food items held above 41F for greater than 4 hours in walk-in refrigerator.
- Observed food held in 1-door refrigerator (rice, mac & cheese, cooked cabbage) and walk-in refrigerator (ribs, chicken) held for greater than 24 hours without being date marked as required.
- Observed two spray bottles with chemicals without being labeled with the common name of the chemicals.
- Observed beans in walk-in refrigerator cooling with container lid left on container.
- Observed ribs thawing in 3-compartment sink in standing water rather than under running water as required.
- Observed walk-in refrigerator holding at 49F, not ensuring food is held at 41F or below as required. Person in Charge relocated any food items held in walk-in refrigerator for less than 4 hours and discarded food items held in refrigerator for greater than 4 hours. Person in Charge will not use refrigerator until it is holding at a temperature to ensure food is held at 41F or below.
- The following items were observed with an accumulation of residue and debris and are in need of cleaning: Bag in box soda containers on shelf under prep table; spice shelf above prep table; plastic containers used to store utensils in prep area; floor fan observed with dust accumulation
- Handwashing sink in back prep area does not have a drain connection and the water is not working.
- Observed dumpster lid left open in back area behind food facility.
- Wall behind prep table observed with an accumulation of residue and debris and is in need of cleaning.
- Observed several holes in the wall in the mop sink area of the food facility. Metal tape used at hood ventilation system observed to be damaged and is in need of repair.
- Observed food employee using dry cleaning methods (sweeping) in prep area while food was uncovered.
- Observed two mops in mop sink area of food facility not hung to air dry.
- Observed light bulbs in front service area without proper shielding.
- Observed several personal items (tools) stored on shelf with food items (spices) on shelves in prep area of food facility.

- The following were observed soiled: 1. The floor throughout the establishment. 2. Caulking between the 3 compartment sink and wall. 3. The vent in the walk-in cooler.
- Observed the following violations: Leaking wall air conditioning unit by back door. Hand washing sink in need of repair next to 3 compartment sink. Leaking food prep unit on the left side of flat top grill. Broken food prep unit on right side of flat top grill.
- Observed the AC unit leaking onto the soda boxes.
- Observed one plastic container of shredded lettuce (45F- 46F) prepared at 6:45 am (exceeded 4 hours during inspection). Person in Charge voluntarily discarded sliced lettuce.
- Observed several pans (food contact surfaces) soiled.
- Observed gloved food employees conducting multiple tasks (opening display cooler, slicing deli, wiping cutting board) and not changing gloves.
- Observed multiple foods employees not washing hands before applying new gloves.
- Observed the following: Person in Charge not monitoring proper handwashing. Person in Charge not monitoring proper cooling of TCS foods. Person in Charge not able to demonstrate knowledge of contact time for proper sanitization of equipment.

- Upon arrival to conduct the inspection a designated person in charge was not onsite. A front desk staff member contacted the person in charge who arrived at 9:00 a.m.
- The front desk staff reported the facility has a certified food manager but could not provide the certificate to validate. Ensure at least one employee in a management or supervisory position is a certified food protection manger
- The person in charge could not provide verification of employee health training of staff but was able to communicate symptoms and illnesses requiring reporting. The person in charge reported the signed employee health documents are held offsite. Ensure employee health training documentation is available during inspections.
- Upon arrival to conduct the inspection hand soap was not available at the only handwashing sink in the facility. The person in charge provided hand soap during the inspection.
- Through discussion with the person in charge coffee and juice nozzles are cleaned and sanitized once a week. Instructed the person in charge to clean and sanitize these surfaces once daily.
- Observed interior of the microwave oven soiled.

- Observed commercially processed hard boiled eggs which have been removed from the original packaging inside the small reach in cooler and an opened container of milk inside the Frigidaire homestyle refrigerator which was not dated to identify the date of opening or discard. During the inspection the person in charge placed a date on the container of hard boiled eggs and the milk was discarded due to cold holding temperature violation. The person in charge reported the hard boiled eggs and milk were opened on 6/11/2022.
- Observed a chemical spray bottle stored less than 4 inches from single use articles (paper) which is used in contact with food. The spray bottle was relocated during the inspection.
- Observed a chemical spray bottle of Quaternary Ammonium sanitizer which measured above 500 ppm on a prep surface in the kitchen. The person in charge reported the chemical spray bottle was used to sanitized the prep surfaces in the kitchen and discarded the spray bottle during the inspection.
- The person in charge could not provide a thin-probed food thermometer.
- Observed the bread and pastries available for consumer self service in the breakfast room are not labeled to identify the ingredients and allergens.
- Observed the following in poor repair: Broken kitchen cabinets, exterior door of the Roper homestyle refrigerator is rusted and ice build-up in the back of the Roper homestyle refrigerator.
- The person in charge provided a Quaternary Ammonium test kit which expired in 2018 and 2019.
- Observed accumulation of debris on the following nonfood contact surfaces: Upsplash of the juice machine and interior cabinets and drawers,
- Absence of adequate backflow preventer observed on the coffee brewer connected to the water line. Observed a manual shut off valve. Backflow prevention handout was emailed to the person in charge.
- The toilet room adjacent to the breakfast area, which is used by employees, is not tight sealing when closed. Staff need to completely close the door.
- Observed 3,8 foot candles of light inside the dry storage room.
