Fredericksburg Restaurant Inspections: Park Lane Tavern, Arby's

During the Rappahannock Area Health District's most recent restaurant inspections, 11 locations were cited by inspectors.

FREDERICKSBURG, VA — Several restaurants around the Fredericksburg and Stafford region were cited with violations during recent inspections by the Rappahannock Area Health District. Eleven restaurants were cited between Dec. 22 and Dec. 28.

As coronavirus restrictions continue to fluctuate around the state, health inspectors are returning to conduct some restaurant inspections in person. However, some visits, such as those for training purposes, can be conducted virtually.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

Here are the most recent violations as listed by the Rappahannock Area Health Department:

  • Burger King #21598, 5635 Plank Rd 117 Fredericksburg, VA 22407
    • Date inspected: Dec. 22
    • Total violations: 2
      • Observed a hose connected to a faucet at the mop sink with the water turned on and a sprayer on the hose, There was no backflow protection device on the faucet which was effective against the constant pressure on the faucet. Water was turned off during inspection.
      • There is no covered receptacle for sanitary napkins in the toilet room used by females.
  • Subway of Stafford, 475 Aquia Town Center #107 Stafford, VA 22554
    • Date inspected: Dec. 27
    • Total violations: 4
      • The food establishment does not have a certified food protection manager and conducts multi-stage cooling of meatballs.
      • Observed four black silicone mats used in contact with bread soiled. The mats were removed to the three compartment sink for cleaning.
      • Observed debris on flooring under shelving units in the back of the house.
      • Observed 0.8 and 8.3 foot candles of light inside the walk in cooler and freezer, respectively.
  • Arby’s #1519, 164 Warrenton Road Fredericksburg, VA 22405
    • Date inspected: Dec. 27
    • Total violations: 10
      • Absence of hand soap at the handwashing sink by the ice machine. The person in charge replaced the hand soap dispenser during the inspection.
      • Observed in use Quaternary Ammonium sanitizing solution in the three compartment sink at 0 ppm. The person in charge discarded the sanitizing solution and set up new sanitizing solution observed at 200 ppm and 75 degrees F.
      • Observed interior surfaces of the ice machine soiled.
      • Observed in use Ecolab No Rinse (Quaternary Ammonium) sanitizer, in a spray bottle, being used to disinfect the meat slicer in the back of the house with no measurable concentration when tested with a testing kit. Food contact equipment was not adequately sanitized. The package and instructions do not specify the concentration required to sanitize food contact surfaces. Instructed the person in charge to discontinue use to sanitize food contact surfaces until more information can be ascertained. Instructed the person in charge use the Kay Quat Quaternary Ammonium sanitizer at the correct concentration.
      • Observed vanilla shake mixture in the shake machine (55 degrees F) cold holding at improper temperatures. The person in charge instructed a food employee to drain the shake machine. Instructed the person in charge to discontinue use of the shake machine and contact a technician for service.
      • Observed improper ambient cooling of in house prepared salads and portioned commercially prepared macaroni and cheese. Observed salads (45-49 degrees F) and portioned macaroni and cheese at 48 degrees F cooling in reach in refrigeration units. The person in charge reported the salads and macaroni and cheese were prepared/portioned at 8:30 a.m. During the inspection the TCS foods were relocated to the walk in cooler. Observed the salads cooled to 39 degrees F and macaroni and cheese to 44 degrees F by 11:45 a.m. Instructed the person in charge to cool the macaroni and cheese to 41 degrees F or less by 12:30 p.m. Discussed cooling TCS foods in the walk in cooler.
      • Accumulation of grime and debris was noted on nonfood contact surfaces of all equipment including inside refrigeration equipment, fryers, and shelving at the cooking and prep areas.
      • Observed the following in need of cleaning: Ceiling tiles, cobweb over light above the CVap and on hood vent filters in the front of the house by the monitor, and exterior vent of prep cooler #1.
      • Observed the following in poor repair: cracked and damaged coving tiles, damaged ceiling tiles by the drive thru, and floor tiles are in need of grouting throughout the kitchen.
      • Observed 3.7 foot candles of light inside the walk in cooler.
  • Planet NOVA Bar & Grill, 1243 Jefferson Davis Highway Stafford, VA 22556
    • Date inspected: Dec. 28
    • Total violations: 13
      • The person in charge could not provide signed employee health policies or other verification food employees have been trained. The person in charge provided a blank, unsigned copy of the employee health policy. Instructed the person in charge to train employees and email signed documents. The person in charge was knowledgeable of symptoms and illnesses requiring restriction or exclusion.
      • Absence of hand drying provision at the only handwashing sink in the kitchen. The person in charge replaced the disposable paper towels during the inspection.
      • Observed white and slimy residue inside a container used to store canned and cooked mushrooms. The person in charge voluntarily discarded the mushrooms for safety.
      • Observed interior of the microwave oven soiled.
      • Observed interior of the ice machine soiled.
      • Observed a cut tomato and a plastic container of mushrooms, which were from canned product, inside the prep cooler without a method to identify the date of preparation/opening or discard date. The person in charge reported the tomato was cut on 12/26/21 and the canned mushrooms have been in the unit over one week. The person in charge chose to discard the cut tomato. The canned mushrooms were discarded due to presence of a white film on the interior of the container. Discussed date marking requirements during the inspection.
      • Observed container of opened canned mushrooms, being stored in a plastic container inside the prep cooler, which were removed from their hermetically sealed cans over one week ago. The person in charge voluntarily discarded the mushrooms due to the presence of a white film on the mushrooms. Discussed disposition requirements for commercially processed TCS Foods.
      • Observed spray bottle of Steramine Quaternary Ammonium solution at the bar area exceeding 400 ppm. The person in charge discarded the sanitizer in the mop sink during the inspection. Discussed Steramine solution concentration thresholds for use on food contact surfaces.
      • Observed two boxes of paper towels stored on the floor in the shelving area of the lower level.
      • Observed the deep freezer and Hot Point homestyle refrigerator, which are stored on the floor in the kitchen and are not easily moveable are not sealed. The equipment is not on casters or elevated at least 6 inches off the floor.
      • Observed accumulation of debris on the following nonfood contact surfaces: Inside refrigeration equiment, shelving throughout the kitchen, interior door of the fryer and back splash of the fryer.
      • Observed the following in poor repair: Doors in the bottom level of the facility are broken and ceiling tiles in the male toilet room are not secured to the frame.
      • Observed less than 5 foot candles of light at the 3 vat sink in the bottom level of the facility. Observed multiple burned out light bulbs in the warewashing area in the lower level.
  • Best Western Aquia / Quantico,2868 Jefferson Davis Highway Stafford, VA 22554
    • Date inspected: Dec. 28
    • Total violations: 5
      • Observed cabinet which holds pastries and bread products, which are available for customer self-service, are not labeled or otherwise indicated to identify the ingredients or potential allergens
      • Observed the door leading into the breakfast area is not self-closing and tight sealing. The door needs to be pushed to completely close.
      • The person in charge provided a Chlorine test kit which expired February 2021. Instructed the person in charge to purchase a new test kit to monitor the concentration of Chlorine sanitizer. The person in charge communicated, through email, the Chlorine testing kit is on order and the expected delivery date is 1/3/22,
      • Observed accumulation of debris and equipment around the dumpster area.
      • Observed equipment not necessary for food service operations being stored in the storage room where refrigeration and dry storage of food is located.
  • Residence Inn, 60 Towne Centre Blvd. Fredericksburg, VA 22407
    • Date inspected: Dec. 28
    • Total violations: 1
      • The PIC provided Sink & Surface Cleaner Sanitizer testing strips for the quaternary ammonium (Oasis 146) sanitizer.
  • Nayeli Salvadorian & Mex Food, 20 Plantation Drive, #149 Fredericksburg, VA 22406
    • Date inspected: Dec. 28
    • Total violations: 2
      • The food establishment does not have a certified food protection manager, the owner's current certification expired November 2021.
      • Observed the following in poor repair: Ceiling lights out in the toilet rooms, ceiling tiles in the female toilet room are not sealed to the frame, and scratches in ceiling tiles in the kitchen
  • Kickshaws Gluten-Free Bakery Incorporated, 1511 Central Park Blvd Fredericksburg, VA 22401
    • Date inspected: Dec. 28
    • Total violations: 13
      • The facility does not have a valid Certified Food Protection Manager certification. The person in charge certification expired 8/2021.
      • Observed food debris in the handwashing sink of the food prep area. In discussion with the person in charge the hand washing sink is used as a food prep sink at times. EHS discussed with the person in charge proper use of a hand washing sink.
      • Observed a container holding 1 head of cauliflower, 1 head of broccoli and a bag of zucchini that were all moldy. During the inspection the person in charge discarded the foods for safety.
      • Observed two containers of canned kidney beans and black beans with a made on date of 12/9. Foods should have been used by or discarded by 12/15. During the inspection the person in charge discarded the beans.
      • Observed portioned out containers of three bean salad and veggie wraps unlabeled in a reach in cooler. Person in charge will label items mentioned.
      • Observed several containers of cleaning chemicals stored on a shelf next to single service use gloves, paper towels and toilet paper. Person in charge will relocate toxic chemicals and will re-arrange the shelf.
      • Observed two food employees prepare foods without a hair restraint.
      • Observed the following: A wire rack used to store clean equipment right next to the 3 compartment sink without a partition or proper spacing to prevent contamination of clean equipment, wire racks (not in use) stored on the floor next to the ovens.
      • Observed ice build up on the top surface and alongside the gasket of the reach in freezer.
      • The person in charge was unable to provide a test kit for the chemical sanitizing dish machine.
      • The interior surfaces of the freezer, reach in cooler, display cooling case and under counter cooler are all in need of cleaning.
      • Observed the following: numerous holes on the wall behind the 3 compartment sink, floor gaps along the wall of the oven area.
      • The following were observed in need of cleaning: floors underneath equipment, AC and ceiling vent in the kitchen area, the interior surface of the exhaust hood vent was very dusty, floor drain underneath 3 compartment sink was heavily soiled/stained with mold like growth.
  • McDonald’s Restaurant #6432, 3102-A Plank Road Fredericksburg, VA 22407
    • Date inspected: Dec. 28
    • Total violations: 5
      • Observed several soiled stirring spoons in a metal container next to the McCafe machine. During the inspection, the PIC relocated the container of stirring spoons to the 3 compartment sink for washing and sanitizing
      • The bag of liquid cream in the milk/cream dispensing machine was at 45 F. The PIC stated the cream had been placed in the dispensing machine at 5 am (at inspection the cream exceeded 4 hours). During the inspection, the PIC discarded the bag of liquid cream.
      • Observed 2 food employees working without hair restraints.
      • The box tops of the following single-service/use articles (ss articles) were cut off and exposed to contamination in the dry storage room: one box of spicy crispy chicken bags, one box of crispy chicken bags, and one box of chicken McNugget boxes. During the inspection, the PIC discarded the exposed ss articles.
      • The following are in need of repair: 1. The paint on the broom closet is peeling. 2. The floor tile in front of the 3 compartment sink and drying rack.
  • Merit School of Park Ridge #14, 81 Parkway Blvd Stafford, VA 22554
    • Date inspected: Dec. 28
    • Total violations: 7
      • Observed food debris on the base of the interior of the microwave oven.
      • Observed a pitcher on the drainboard of the 3 vat sink used to store a blue substance, which the person in charge reported was dish detergent, which was not labeled to identify the contents. A food employee placed a label on the container during the inspection.
      • Observed numerous unwrapped rolls of paper towels in the employee toilet room stored on a shelf across from the toilet. Single use articles are stored in a manner which could be exposed to contamination. Discussed storing disposable paper towels in their original wrapping to prevent contamination during storage.
      • Observed the food establishment is reusing manufacturer containers of yogurt to store marinara sauce, ketchup and cut fruit. Instructed the person in charge to discontinue reuse of manufacturer containers for food storage.
      • Observed the Quaternary Ammonium testing kits expired on 7/2021 and 2013. Instructed the person in charge to purchase a new test kit.
      • Observed accumulation of debris on the following non food contact surfaces: Interior door and base of the two ovens, cabinet in between the ovens, base of 1 door upright freezer #1 and #2
      • Observed three wet mop head stored inside the basin of the mop sink. Discussed correct storage of mops to allow air drying.
  • Park Lane Tavern, 1 Towne Center Blvd. Suite #4100 Fredericksburg, VA 22407
    • Date inspected: Dec. 28
    • Total violations: 13
      • Observed a strainer in the handwashing sink at the bar and a clear container of clean dishes in the handwashing sink in the warewashing area. During the inspection, the bar employee assigned a different sink as the handwashing sink and the container of clean dishes was removed
      • Observed 3 ice cube trays covered in ice buildup from the mini freezer at the bar. During the inspection, the bar employee discarded the ice and stated they would cover the ice trays to prevent contamination.

      • Observed 1 bottle of hand soap and 1 spray bottle of glass cleaner being stored next to clean glasses at the bar. During the inspection, the bar employee relocated the soap and cleaner.
      • Observed 28 thawed ROP salmon in a metal container in the salad prep unit. The label on the ROP stated, "Keep frozen. Remove from package. Thaw under refrigeration immediately prior to use. During inspection, the PIC discarded the 28 salmon.
      • Observed 2 food employees preparing the server station without hair restraints.
      • Observed several colored plastic straws that were not protected from contamination in a metal tray in the bar's 3 compartment sink. During inspection, the bar employee discarded the straws
      • The 3 compartment sink in the warewashing area is not sealed to the adjoining wall.
      • The following are in need of repair: 1. The mini freezer in the bar. 2. The salad prep filter cover. 3. The cold holding drawers under the grill.
      • Observed 2 chipped/bent cooking spatulas next the panini grill. During the inspection, the PIC discarded the spatulas
      • There is no working test kit for monitoring the concentration of the chemical sanitizing solution in the 3 compartment sink.
      • The following are in need of cleaning: 1. The mop sink. 2. The two handwashing sinks at each end of the cook line. 3.The shelves in the walk in cooler.
      • The following are in need of cleaning: 1. The floor under the dishwasher and the wall behind the dishwasher. 2. All floor drains. 3. Under equipment in the bar and kitchen cook line.

However, not all the restaurants that the health department visited had violations. Here are a list of locations that were visited, but had no violations. Some were visited as part of pre-opening inspections, while others received routine or follow-up visits.
