Pedestrian Struck, Killed In Spotsylvania County; No Charges For Driver: Police

A 44-year-old woman died after an SUV hit her in Spotsylvania County on Friday night, police said. The driver will not face charges.

SPOTSYLVANIA COUNTY, VA — A pedestrian died after an SUV hit her on Friday evening, the Spotsylvania County Sheriff's Office. No charges will be filed in connection with the crash, authorities said.

Deputies arrived on the scene in the 10800 block of Tidewater Trail around 9:20 p.m. on Friday night. Investigators determined that a 2008 Ford Edge was travelling westbound on Tidewater Trail before the crash.

The SUV struck a pedestrian that was trying to cross Tidewater Trail, police said. The pedestrian, who police identified as 44-year-old Shawn Melissa Fortune-Garnett, was not in a crosswalk, the sheriff's office said. Authorities also noted that the area was poorly lit and Fortune-Garnett was wearing dark clothing.

Emergency personnel took Fortune-Garnett to Mary Washington Hospital, where she died as a result of her injuries.

The driver stayed on the scene after the crash, police said.

Deputies with the sheriff's office's accident reconstruction unit presented their findings to the Commonwealth's Attorney's Office. Authorities decided not to file charges against the driver of the SUV, who police only identified as a 46-year-old woman.
