New Airbnb Regulations To Go Into Effect Next Year In Herndon

Property owners who rent their homes on popular sites like Airbnb and VRBO must follow the new regulations starting Feb. 1.

HERNDON, VA — Property owners who rent their homes out on popular sites like Airbnb and VRBO will soon be subject to new regulations adopted by the Town of Herndon. The new regulations will go into effect Feb. 1, according to town officials.

As part of the new regulations, homeowners must register with Fairfax County and pay $200 to receive a two-year permit to operate their rentals.

  • Those applying for a permit must reside at the property at minimum 7 months per year. They must also provide proof of residency, or have owner authorization if they rent the property. Homeowners must also provide notice to their HOA or COA.
  • The maximum number of nights allowed to rent properties in Herndon will be 90, compared to 60 nights in Fairfax County and 180 in nearby Arlington and Loudoun counties.
  • A single rental period may not exceed 30 days.
  • The maximum number of adults allowed in each rental is six, which includes permanent residents.
  • Lodging only is permitted in rentals; events are prohibited in homes.
  • Failure to register a rental will result in a $500 fine.

Herndon’s regulations, which were approved by council members earlier this month, are similar to legislation adopted by Fairfax County’s Board of Supervisors this year, Reston Now reports.
