Leesburg Health Inspections: Rebellion Bar & Kitchen, Bua Thai

The Loudoun County Health Department recorded violations at several facilities around Leesburg during recent restaurant inspections.

LEESBURG, VA — Several restaurants around Leesburg and western Loudoun County recorded violations during recent inspections from the health department. Inspectors conducted the most recent restaurant visits between Jan. 25 and Jan. 31.

Most COVID-19 restrictions around the state have relaxed, so health inspectors are returning to conduct some restaurant inspections in person. However, some visits, such as those for training purposes, can be conducted virtually.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

    • Date inspected: Jan. 25
    • Total violations: 1
      • Observed: 2 gallons of milk have gone beyond use-by date. Milk that has gone beyod the use-by date does not meet Grade A Standards. Milk needs to meet Grade A standards. Corrected by voluntarily discarding.
  • Anthony's Italian & Mediterranean, 620 West Main Street Purcellville, VA 20132
    • Date inspected: Jan. 25
    • Total violations: 5
      • Observed shellfish tags not properly dated with when the last shellstock from the container was sold or served. Date the tags with when the last shellstock from the container was sold or served.
      • Observed several raw animal proteins thawing improperly. Raw animal proteins were observed thawing out of the counter at room temperature.
      • Observed several food items stored on the floor in the walk in freezer and walk in refrigerator. Food shall be stored at least 6 inches off the ground.
      • Observed pizza conveyor in need of cleaning. Conveyor observed with an accumulation of food debris. Also observed mixer in need of cleaning. Mixer observed with an accumulation of flour.
      • Observed harborage conditions at outside trash area. Several unused equipment that appears broken.

    • Total violations: 2
      • Observed no signage in women's to remind employees to wash hands.
      • Observed cut cabbage 53F in prep cooler with improper cold holding temperature foods held cold should be maintained at 41F or below.
  • Sakura Japanese Steakhouse, 516 Fort Evans Rd, NE Leesburg, VA 20176
    • Date inspected: Jan. 26
    • Total violations: 4
      • No supervisors or managers are certified food protection managers (CFPM). A CFPM is required to be available to manage food safety in the facility. Training is required.
      • Hands are being washed at the 3 basin sink at the bar. Hands are to be washed at a handsink and not at the sink used for cleaned equipment.
      • Time as public health control (TPHC) is being used for holding rice without temperature control. Records are needed for rice for time control to determine time prepared and discarded within 4 hours.
      • Many items observed dirty and in need of cleaning and sanitizing. Clean and sanitize the interior of the ice machine, the clean drain board at bar 3 basin sink and bottle rack at bar.

      • REPEAT - Cold holding at improper temperatures in coolers. Chicken observed at 51F, cut tomatoes at 50F.
      • Repeat-Proper date labeling of cooked, ready-to-eat items. Cooked chicken made 6 days ago is not date label to discard or use with 7 days.

    • Date inspected: Jan. 27
    • Total violations: 1
      • Observed 3 containers of cooked noodles in the walk in cooler in need of disposition. Cooked noodles were prepared on 1/20 and have exceeded the 7 day shelf life, with day one counting as the date the foods were prepared.

    • Date inspected: Jan. 30
    • Total violations: 4
      • Observed no hand washing cleanser at hand washing sink by walk in refrigerator. Hand washing sinks shall be supplied at all times.
      • Observed no hand drying provision at hand washing sink by the cook line. Hand washing sinks shall be supplied at all times.
      • Observed 2 types of reduced oxygen packaged fish, Mahi and Salmon, prepared in the facilities satellite location and stored under refrigeration in this facility. Fish was observed labeled with the date packaged. Dates included 1/30, 1/27. Except for fish that is frozen before, during, and after packaging and bears a label indicating that it is to be kept frozen until time of use, a food establishment may not package fish using a reduced oxygen packaging method.
      • Observed kitchen floors in need of repair. Several tiles are cracked/ broken. Also observed back door with significant daylight coming from seams of door. Back door is no longer tight fitting.

    • Date inspected: Jan. 30
    • Total violations: 2
      • Observed: Salmon being thawed is still in its reduced oxygen packaging (ROP) environment. ROP fish that bears a label indicating that it is to be kept frozen until time of use needs to be removed from the ROP environment during thawing.
      • Observed: Door to new restroom door (in new bar area) is not self closing. Doors to restrooms need to be self-closing.
  • Spanky's Shenanigans, 538 Market Street East Leesburg, VA 20175
    • Date inspected: Jan. 30
    • Total violations: 4
      • Dishwasher sanitizing by hot water is not reaching required temperature. Observed plate reaching 154F and not the minimum of 160F.
      • Ice is being scooped with a bucket that does not have a handle to protect ice from hand contact. Use a utensil or scoop that has a handle.
      • An irreversible registering temperature indicator was not provided for the hot water mechanical warewashing operation. The thermometer is not working properly and not being used to monitor dishwasher sanitizing temperatures.
      • Floor at walkin coolers has standing water and beer cooler in need of maintenance and cleaning.

      • Cut and washed lettuce is stored on prep table not under temperature control. To utilize time as a public health control (TPHC), a written policy must be in place and time monitored.

      • Observed: Current employees (at time of inspection) do not have an employee health policy that is verifiable. Each food handling employee is required to have a verifiable means (employee health policy 1B form) tht exemplifiefies that they have been trained in the signs and sumptoms of foodborne illness.
      • Observed: Time/temperature control for safety (TCS) sandwich spread in the true (low boy) prep reach in does not have label/date mark indicating use-by date. TCS foods that have been prepared in-house need to have label and 7 day use by by date.
      • Observed: 1/2 and 1/2 held at time as a public health control (TPHC) does not have documentation that it is being held at TPHC. Food items can be brought at at temperature (41F) and held for 4 hours under "time" after which they are discarded.
      • Observed:Ice scoop handle is in touch w/ice that is used for beverages. Ready to eat food (ice) needs to be protected from handles of ice scoop to prevent contamination. Corrected by by storing handle of ice scoop above ice.
      • Observed:There are no test strips available to test the parts per million (ppm) of quaternary ammonia from the 3 compartment sink dispenser.
      • Observed: lighting at the prep table (where knives are used) does not have adequate lighting (50 foot candles) at surface where food employee is working with knives, etc.

    • Total violations: 5
      • Observed food employee wash hands at 3 compartment sink. Hands should not be washed where food is prepped or food utensils are sanitized.
      • Observed raw chicken stored over cooked chicken in walk in cooler. Raw proteins should be stored in a way to minimize cross-contamination.
      • Observed improper hot holding temperature of scrambled egg 120F foods held hot should be maintained at 135F or above.
      • Observed beans & cheese, pork & cheese, and Queso on the counter out of temperature control. Person in charge that Time as a Public Control (TPHC) is being use without written procedures.
      • Observed tile that is broken and missing near the 3-compartment sink. Floor coverings should be designed to be smooth and easily cleanable.
  • The Wine Kitchen / Paulie's Italian, 7 South King St Leesburg, VA 20175
    • Date inspected: Jan. 31
    • Total violations: 2
      • Observed bar hand washing sink used for dumping beverages. Bar hand washing sink was observed with a strainer in the sink and drink residue in the strainer. Hand washing sinks shall be used for hand washing only.
      • Observed cutting board on prep line heavily scratched and scored. Cutting board can no longer be effectively cleaned and sanitized.
  • Rebellion Bourbon Bar & Kitchen, 1 N. King Street Leesburg, VA 20175
    • Date inspected: Jan. 31
    • Total violations: 6
      • Observed no hand drying provision at hand washing sink near the dish machine. Hand washing sinks shall be supplied at all times.
      • Observed raw beef and raw chicken stored over ready-to-eat salad mix and prepared mashed potatoes in the walk in refrigeration unit. Food shall be stored in an order that prevents potential cross contamination.
      • Observed kitchen dish machine with 0 PPM chlorine. Kitchen dish machine is not properly sanitizing dishes.
      • Observed cooked onions (99F), cooked mushrooms (97F, and cheese sauce (122F) hot holding at improper temperatures on the flat top.
      • Observed facility to offer foods raw or undercooked and not asterisk each individual food item to reference the footnote statement that states the items are raw or undercooked and consuming raw or undercooked foods may increase your risk of foodborne illness.
      • Observed chicken thawing in the 3 compartment sink improperly. Chicken raw observed thawing in standing water. Also observed fish thawing improperly. Fish was observed thawing at room temperature.
  • Bua Thai, 19326 Promenade Dr Leesburg, VA 20176
    • Date inspected: Jan. 31
    • Total violations: 5
      • Observed the plastic guard in the ice machine with a blackish substance. Non food contact surface should be clean at a frequency to not allow a build up soiled residues.
      • Observed pots being stored on the floor under the dishwasher food contact should not be store on the floor.
      • Observed no paper towels by hand sink in kitchen employees should have paper towels available to dry hands.
      • Not all employees had a verifiable means that all employees had been trained on the signs, symptoms, and exposers to foodborne illnesses.
      • The Certified Food Protection Manager certificate expired on 4/4/2022. Last inspection there was not a current Certified Food Protection Manager. Certified Food Protection Manager certificate should be kept current.

    • Date inspected: Jan. 31
    • Total violations: 2
      • Observed: Guacamole temperature in low boy prep table below acceptable cold holding temperature (41F). Aioli (TCS food item) in unit below prep table also registering a temperature below acceptable cold hold temperatures. TCS food items kept at cold holding need to be 41F or below).
      • Observed: Eggs offered undercooked on menu do not have a consumer advisory (reminder and disclosure). The Consumer Advisory shall include a disclosure statement that includes a description of the animal-derived foods offered raw or undercooked and identification of the animal-derived foods by asterisking (*) them to a footnote that states that the items are served raw or undercooked, or contain raw or undercooked ingredients.
  • Souvlaki Bar, 9 A Catoctin Circle SW Leesburg, VA 20175
    • Date inspected: Jan. 31
    • Total violations: 2
      • Chicken soup hot holding at improper temperatures (131F. Maintain time/temperature control for safety foods (TCS) hot holding temperature at 135F or higher. Corrected at inspection.
      • Spanakopita (spinach pie) is being held on top of stove top, and is not under temperature control (being held at 41F or below or 135F and above). Documentation is required if Time as a Public Health Control (TPHC) is being used. If time only, rather than time in accordance with temperature control, up to a maximum of 4 hours, is used as the public health control the food shall: 1) have an initial temperature of 41°F or less if removed from cold holding temperature OR 135°F or above if removed from hot holding temperature control, 2) be marked or otherwise identified to indicate the time that is 4 hours past the point in time when the food is removed from temperature control, 3) be cooked and served, served if ready-to-eat, or discarded within 4 hours from the point in time when the food is removed from temperature control, and 4) be discarded if unmarked or marked to exceed a 4 hour limit.
