No Charges For Officers Who Shot Man In Woodbridge: PWC Police

No criminal charges will be made against two officers for returning fire during a shooting incident Nov. 4 in Woodbridge: PWC Police.

WOODBRIDGE, VA—No criminal charges will be made against two officers for returning fire during a shooting incident Nov. 4 at 1106 Laurel Street, Prince William County Police announced Thursday. Commonwealth's Attorney Paul Ebert said "the evidence indicates that the responding officers used great restraint and used deadly force only when necessary."

Shortly after 5:30 p.m., police responded to the area for a "shots fired" 911 call. As they arrived, a man began shooting at them with a rifle from the roof of a home, and a police cruiser was his multiple times. Police returned fire and hit him in the upper body, after which he was taken to a nearby hospital with serious injuries.

One officer was hit by a round in the back across his exterior ballistic vest. He was taken to an area hospital as a precaution. Other homes in the area also were hit.

The man, Brett Anthony Monteith, was charged Nov. 8 with attempted capital murder of a law enforcement officer and one count of using a firearm in commission of a felony.

The two officers involved were Evan Jurgensen, 25 (2.4 years of service with PWC Police), and John Yenchak, 22 (1.5 years of service). Both have returned to full duty and initially being placed on paid leave.

On Thursday, police also released a detailed report on the shooting. They found that Monteith shot himself, prompting his grandfather to call 911. At some point between the call and the arrival of police, Monteith got onto the roof of the home.

The first responding officers got there around 5:45 p.m. and immediately were fired on by Monteith, who had a .22 caliber rifle. Ultimately, Monteith was subdued in front of the residence around 5:50 p.m.
