Waukesha Man Charged with 4th OWI

Suspect allegedly was doing 70 miles per hour in a 45 miles per hour speed zone.

A 34-year-old Waukesha is facing a felony after he was allegedly caught driving under the influence for the fourth time.

David E. Shackton was charged in Waukesha County circuit Court Friday with one count of fourth-offense operating while intoxicated following a traffic stop in the Town of Vernon. If convicted, he faces up to six years in prison and $10,000 in fines.

According to the criminal complaint, at 12:04 a.m. Friday, a Waukesha County Sheriff’s deputy saw Shackton driving northbound on Highway 164 near Highway ES and doing 70 miles per hour in a 45 miles per hour speed zone. The deputy pulled over Shackton, who said he thought he was doing only 60 miles per hour.

The complaint alleges Shackton told the deputy he had consumed “two or three” glasses of wine at dinner. He was unable to pass a field sobriety test and the complaint states Shackton had a blood alcohol level of 0.12 percent at the time of his arrest.

Shackton was previously convicted of OWI in March 1999, September 1999 and December 2008. He’s being held in Waukesha County Jail on $2,500 cash bond.
