BIRMINGHAM, AL — Capital murder charges against a Birmingham man in the shooting death of 42-year-old Demegious Osborne in June have been dropped. Jeremiah Lorenzo Rapley was released from the Jefferson County Jail Friday after being held without bond.

The case against Rapley was set for a preliminary hearing on Friday, Sept. 13. However, the Jefferson County District Attorney’s Office requested that the case be dismissed because there was not sufficient evidence to move forward.

The shooting happened just after 3 p.m. June 14 in the 900 block of Ninth Street North. Authorities said it appeared Osborne was sitting in his vehicle when he was approached by another man - now identified as Rapley – and some kind of exchange took place which reportedly led to the gunfire.
