Justifiable Homicide Reclassified As Murder: Birmingham Police

A homicide in August that had been ruled justifiable by investigators has now been reclassified.

BIRMINGHAM, AL —A fatal shooting ruled in August as a justifiable homicide by investigators has been reclassified by Birmingham police as murder. The incident occurred August 19 in the 300 block of Gamma Street.

Mario Kindred, 32, of Fairfield was shot and killed after what police said was an altercation with a woman who later fled the scene before turning herself in to the Birmingham Police Department, according to Sgt. Rod Mauldin.

Mauldin said that on October 22 investigators re-submitted the case to the Jefferson County District Attorney’s Office based on additional developments in the case, and no longer consider the homicide justifiable.

"The suspect in this case is currently at large," Mauldin said in a release. "The suspect’s identity will remain confidential for operational purposes. The identity of the suspect will be released upon apprehension."
