Bama Basketball Shooting Latest: Key Witness Served Subpoena Ahead Of May 24 Hearing

A key witness in the shooting death of Jamea Harris has been served a subpoena to testify at a hearing later this month.

TUSCALOOSA, AL — Defense attorneys for former Alabama basketball player Darius Miles have successfully served a subpoena on a crucial witness in the Jan. 15 shooting death of Jamea Harris on Grace Street.

Court records obtained by Patch show that 23-year-old Birmingham native Shu'Bonte Greene was served his subpoena on Tuesday to testify at the next hearing later this month.

According to Jefferson County jail records, Greene is currently behind bars with his bond denied for first degree receiving stolen property and failure to appear in court. Jail records show this offense originated in Pelham.

As for Greene's potential role in the investigation, video evidence shows his red Impala parked at a nearby apartment complex the morning of Jan. 15, before Harris' Jeep, driven by Johnson, pulls up.

Just minutes before the shooting — 1:41 a.m., to be exact — Johnson can be seen getting out and speaking with Greene, who does not exit the car. However, during one clip shown in court during the preliminary hearing, an unidentified man can be seen getting out of the back of the Impala and retrieving an item from the trunk.

The shooting occurred at 1:45, less than five minutes after Johnson and Greene met up a street over from Grace Street.

During the May 24 hearing, bond will be considered for Miles and Maryland native Michael Davis, in addition to Circuit Court Judge Daniel Pruet ruling on issues relating to discovery evidence.

It's worth noting that Greene was served a subpoena ahead of the preliminary hearing in February, but didn't show up to court.

As Patch previously reported, Miles and Davis were both charged with capital murder following the shooting in the early morning hours near The Strip, but questions have been raised as to the possibility of who was acting in self-defense and the other circumstances leading to the shooting.

What's more, both the Tuscaloosa County District Attorney's Office and the defense attorneys for Miles — from the Turner Law Group — requested subpoenas be issued for Cedric Johnson, who shot Davis twice during the altercation on Grace Street.

Johnson was driving Harris' Jeep at the time of the shooting and defense attorneys have argued that video evidence seems to show Johnson firing the first shot in the altercation, as Davis could be seen running up to the side of the Jeep with Miles's legally owned pistol in his hand.

The latest filing by the Tuscaloosa law firm also sought subpoenas for Asia Humphrey, who was in the back seat of Harris's Jeep during the shooting, along with bystander Eileen Carbin.

As Patch previously reported, Humphrey was subpoenaed by the defense for the preliminary hearing and testified under oath.

A junior at the University of Alabama who is related to Harris, Humphrey provided little to no sworn testimony to date that has corroborated supposed facts of the case provided by Johnson to investigators in the immediate aftermath of the shooting.

The May 24 hearing is set for 9 a.m. in Circuit Court Judge Daniel Pruet's courtroom at the Tuscaloosa County Courthouse.
