Nicholas Moseby Set To Stand Jury Trial: Report

The former Danville teacher charged with sexual molestation will be arraigned in January, and then face a jury trial.

DANVILLE, CA — A former Danville middle school teacher and cheerleading coach charged with felony sexual misconduct is set to stand trial, Danville San Ramon reported.

Nicholas Moseby, 41, is facing allegations from five different minors of sexual harassment and molestation during his time as a cheer coach with NorCal Elite in San Ramon and as a science teacher at Diablo Vista Middle School and San Ramon Valley High School. Moseby has pleaded not guilty to the charges.

He will stay in jail until he is arraigned Jan. 3, according to Danville San Ramon. On Friday, a Contra Costa County Superior Court judge declined to reduce Moseby’s $125,000 bail.

Moseby was arrested in September on charges of lewd acts upon a minor, child molestation, and sending a lewd video to a minor. Evidence has emerged that Moseby had at least three criminal prosecutions before he was hired at SRVUSD, which included providing alcohol to a teen and being arrested in a prostitution sting. Further reporting has found that the district failed to act on reports of Moseby’s inappropriate behavior.

The district has said that it is reviewing its hiring and background check procedures.
