3 Milpitas Police Officers Injured in Scuffle With Suspect

They were attempting to arrest a transient for allegedly exposing himself at a children's play area at a fast food restaurant.

Milpitas, CA - A transient was arrested in Milpitas for allegedly masturbating at a children's play area in a fast food restaurant and a struggle with police that left three officers injured last month, police said.

Frank Marquez Jr., 52, was arrested on suspicion of indecent exposure, attempting to disarm a police officer and battery on a police officer, police Sgt. Dave Morris said.

Shortly before 8:30 p.m. on June 23, officers responded to a report of someone masturbating at the play area of a McDonald's at 99 N. Milpitas Blvd., Morris said.

Arriving officers found Marquez, who became combative as they tried to arrest him, according to Morris.

Marquez allegedly hit an officer's head and tried to remove a police service weapon. The suspect was unsuccessful in his effort as more officers responded and placed him in custody, Morris said.

Three officers were left with minor injuries from the struggle and were treated at a hospital, Morris said.
Marquez was booked into Santa Clara County Jail, according to Morris.
