This employment agreement is being entered into in order to specifically outline the terms and conditions of employment for Anabel Mejia and Florencia Mejia while working for Mejia Family, Inc. dba. Don Pico’s Mexican Bistro. The employment agreement is limited in time and subject to the following terms and conditions and dates that are agreed to.

· For the continued work at Don Pico’s both Anabel Mejia and Florencia Mejia will each receive the amount of Ten Thousand ($10,000.00) dollars that is guaranteed to be paid as follows: The sum of Five Thousand ($5,000.00) dollars shall be paid to each party upon the signing of this agreement. This has to happen no later than October 2, 2012 by 5:00pm. The 2”d payment shall be for an additional Five Thousand ($5,000.00) dollars each and it is due on October 20, 2012 by 5:00pm.
· All payments should be run through the Payroll system with the proper payroll withholding being applied.
· By signing this agreement the employer is/has agreed to guarantee the Ten Thousand ($10,000.00) dollars to Anabel Mejia and Ten Thousand ($10,000.00) dollars to Florencia Mejia even if they are terminated for any reason by employer during the term of this agreement.
· All payments are further guaranteed to be paid no later than October 31, 2012. For any reason should the bank the payments are drawn upon not honor the payments, Lucy Mejia will then become personally liable for the payments and all bank charges that may occur under the same conditions as referenced above. Lucy Mejia will also guarantee these payments.
Conditions of Work
Both Anabel Mejia and Florencia Mejia will work “as usual” as they have done for over thirty (30) years. They will continue to work until the end of the dinner shift on October 31, 2012.
This employment agreement must be signed no later than October 1, 2012. Failure to have all parties’ sign this agreement by October 1, 2012 will cause Anabel Mejia and Florencia Mejia to consider them terminated and Mejia Family, Inc. and/or Lucy Mejia

Anabel Mejia, and Florencia Mejia
agree to pay Anabel Mejia and Florencia Mejia any and all payroll owed them on a pro- rata basis to that date, October 1, 2012.
Restrictions on Lucy Melia
· Lucy Mejia is prohibited from coming down to Don Pico’s for the term of this agreement.
· Lucy Mejia may visit the accounting office at 481 El Camino Real San Bruno, C in order to discuss business matters with Lee Johnson.
· Lucy Mejia agrees and confirms that she will never disturb the peace, contact in any manner, either directly or indirectly, the parents of Anabel and Florencia Mejia (namely Isaac and Herlinda Mejia) for any issues relating to Don Pico’s Restaurant. Doing so immediately terminates this agreement and all payments unpaid to either Anabel Mejia or Florencia Mejia become due and payable immediately.
Additional Training to Don Pico’s staff
Any training rendered to either the existing staff, new employees, and or consultants hired by Mejia Family, Inc. or Lucy Mejia shall bear compensation due to either Anabel or Florencia Mejia or both. That amount of the compensation shall be one hundred ($100.00) dollars per hour and billed separately of payroll. The compensation for hours or fraction of hours worked for the training shall be paid with no federal or state tax withholding and paid immediately after the training session.
Any and all training sessions shall be pre-planned and scheduled so as not to interfere with the normal duties of operating the restaurant.
By your signature below all parties involved in this agreement have agreed to the terms and conditions of this agreement and further agree to conduct them in a professional manner within the spirit of this agreement.
