Jesse Adrian Wagner was exonerated after the court found him to be factually innocent for crimes which sent him to prison.

District Attorney presented perjured testimony to convict Jesse Adrian Wagner of Temecula, California

TEMECULA, CA – After more than a decade of fighting for his innocence, a San Bernardino Court exonerated Jesse Adrian Wagner, finding him factually innocent for the crimes which sent him to prison for nearly 10 years of his life.

The finding by the Court signifies that newly discovered evidence of factual innocence has been discovered that requires the conviction to be vacated and dismissed. Jesse Adrian Wagner was arrested in 2003 on suspicion of robbery and impersonation of a police officer. The alleged victim was never shown a photo line up and never identified Wagner as the robber. At trial, the alleged victim told the jury that he was detained by a man that appeared similar to Wagner. When the alleged victim got his wallet returned to him, he was missing his social security card and a visa. The jury convicted Wagner and the Court sentenced him to state prison.

Long after his appeals were denied, a new law passed. Governor Brown changed the law to allow a factually innocent person to ask the court to dismiss the conviction when new evidence of actual innocence was discovered. Previously, although innocent, there was no recourse.

A private investigator interviewed the alleged victim. During the interview, he admitted that he was not robbed of neither the social security card or visa. Apparently, he was not lawfully in the United States. After Wagner was convicted, the District Attorney was able to assist him with obtaining a victims visa and from that he was issued a social security card and visa. The statement demonstrated that the District Attorney was aware he did not have a social security card or a visa – the testimony was falsified.

In exonerating Wagner, the Court said that newly discovered evidence of actual innocence requires this conviction to be dismissed.
