Lawmaker DIA Gun Arrest: Denver District Atty. Recuses Herself
Denver District Atty. Beth McCann has turned the State Rep. Lori Saine case over to the Boulder DA because of her relationship with Saine.

DENVER, CO -- Denver District Attorney Beth McCann said her history as a fellow legislator in the Colorado General Assembly with accused State Rep. Lori Saine means that she cannot hear the case. McCann announced Monday she would be turning the case over to the the 20th Judicial District Attorney’s Office (Boulder County), which has agreed to be the special prosecutor in the matter.
State Rep. Lori Saine (R-Dacono) was arrested Dec. 5 at Denver International Airport, and spent the night in jail, after allegedly bringing a loaded Kahr Arms 9mm semi-auto handgun in her carry-on bag into a transportation facility, which is a class-six felony.
McCann said she and Saine "worked closely together in 2015 to sponsor and enact the felony DUI law," a statement said. "Given [McCann's] personal connection to Representative Saine, in the interest of justice and to ensure fair and impartial consideration of the matter, McCann determined the involvement of another district attorney’s office would be appropriate."

When the Denver Police Department concludes its investigation, it will present the case, if any, to the Boulder District Attorney’s Office for consideration as to the filing of charges, McCann's office said.
