DOUGLAS COUNTY, CO — No charges will be filed in the case of a woman's shooting death in a Lone Tree apartment complex, the Douglas County Sheriff's office said. The woman was shot during a dispute Oct. 18, authorities said.

Deputies were called to the apartment building at 3:54 p.m. and were told that shots were fired and someone may have been hit, officials said.

Officers then went into an apartment and found a woman with a gunshot wound to the face. The officers began CPR on her, but she was pronounced dead soon after. The Douglas County Coroner's office identified the woman as Kelly Kiess, 24. A handgun was found in her pocket after the shooting, court documents show.
Andy Bernadeau, 22, was standing next to Kiess as she lay on the floor, and he was yelling, "he didn't give a warning shot!" according to the affidavit.
Bernadeau told deputies he had just moved into the apartment with his Keiss, his girlfriend, but he didn't have an apartment access key yet. He followed Chaney into the building, so Chaney asked Bernadeau whether he had a key. The two began arguing and Bernadeau said he slapped Chaney.
Keiss then came out of their apartment and also began arguing, and then went back inside and retrieved a gun, court documents show. She then pointed the gun at Chaney and he shot her in the face, according to the affidavit.
Chaney said he feared for his life and shot her in self-defense.
Nobody in the case has been charged, Douglas County authorities said.
