Mother of Man Killed by Danbury Police Claims Her Rights Violated
Linda Arbitelle, who is still in intensive care at Danbury Hospital, served notice through her lawyer.

DANBURY — The woman who was wounded when her son was fatally shot by police at the Glen Apartments has filed notice with the city that she intends to sue for compensatory and punitive damages, the New Times is reporting.
Linda Arbitelle, 74, who is still in intensive care at Danbury Hospital, served notice through her lawyer.
The notice indicates that Arbitelle will be seeking damages for excessive force, negligence, assault, battery, violation of her civil rights and “claims of failure to properly supervise officers and failure to properly train officers, and negligent and intentional infliction of emotional distress,” according to the News Times.

On Dec. 29, police responded to a report of a "suspicious male" at the Glen Apartments, according to a state police report. The knife-wielding man, later identified as Paul Arbitelle, was shot by police when a taser proved "ineffective," the state police said in a release. The officer involved in the shooting was in "imminent, life-threatening danger and acted in self-defense" according to a release later issued by the Danbury Police Department.

A spokesperson for the state medical examiner's office said that Paul Arbitelle died as a result of "homicide gunshot wounds to the torso and extremities."
