Suit: Glastonbury 3040 Main St. Dunkin' Not Authorized To Use Brand

A lawsuit has been filed against a Dunkin' shop on Main Street in Glastonbury.

GLASTONBURY, CT — A holding company authorized to own Dunkin' Donuts franchises is suing a Dunkin' shop in Glastonbury while claiming the local shop has lost its authorization to use the brand.

The lawsuit was filed Dec. 6 by DD IP Holder LLC. in the U.S. District Court for the District of Connecticut.

In the suit DD IP claims it is trying to "stop a former Dunkin' Donuts franchisee from operating as if it were still an authorized franchisee."

The franchise in question is located at 3040 Main St. in Glastonbury and the registered owner is A.B. Corp., listed under the same address. According to the suit, A.B. is a "former" Dunkin’ Donuts franchisee. The suit claims that A.B. Corp.'s franchise agreement was terminated "due to uncured health and safety violations and other failures to comply with franchise brand standards."

The suit also said, "A.B. Corp. is, therefore, no longer authorized to use the Dunkin' Marks at the Main Street Restaurant."

The lawsuit claims the use of the Dunkin' brand continues illegally.

"This unlawful and unauthorized conduct is causing irreparable damage to Plaintiff and its Dunkin’ Marks and must be stopped," the suit claims.

A man answering the phone at 3040 Main St, Dunkin' identified himself as the owner. When asked if he wanted to respond to the suit, he responded that he was "unsure" about any lawsuit against the shop or A.B. Corp.

DD IP is identified in court records as being the owner of several franchise locations.

A separate civil action was filed two days earlier by Dunkin' Franchising exercising similar claims, according t0 the suit.
