Milford Facing Another Affordable Housing Lawsuit: Report

The PZB denied a proposed affordable housing application at its meeting Tuesday night.

MILFORD, CT - Here we go again.

It appears that the city of Milford will soon be sued over the Planning and Zoning Board’s unanimous rejection Tuesday night of a 9-unit housing proposal, which included three units of affordable housing.

The Milford Mirror reports that a representative of the applicant said the vote outcome wasn’t surprising and they plan to appeal the PZB’s denial.

Because it’s an affordable housing application the burden of proof is on the city to provide there are legitimate health and safety concerns, which warrant the application’s denial.

Routinely, courts side with the developer over the municipality unless a community has 10 percent of its housing stock designated as affordable according to state guidelines and Milford is only around 6 percent.

Zoning officials cited insufficient sitelines and traffic may be too fast for the area, which was a concern echoed by concerned residents, the Mirror reports.

The 1.18-acre parcel includes two existing houses and the plan included constructing an additional 7, 2-bedroom cottages on the property.
