DERBY, CT — Gino DiGiovanni Jr., a former Derby alderman who ran for mayor earlier this year and lost in November, plans to plead guilty to a misdemeanor charge related to his presence at the U.S. Capitol on Jan. 6, 2021, NBC News reports.

According to NBC News, DiGiovanni's lawyer and court documents indicate DiGiovanni faces a charge of entering and remaining in a restricted building. A federal judge in Washington has set a plea agreement hearing for Jan. 3.

DiGiovanni, 42, turned himself in at a New Haven federal court in August to face charges related to his presence inside the U.S. Capitol.

NBC Connecticut reports DiGiovanni told the publication in October he had entered the U.S. Capitol on Jan. 6 after attending then-President Donald Trump's nearby "Stop the Steal" rally. He was not an alderman at that time, but was later elected to the position and later ran for mayor.

DiGiovanni was one of four candidates on the ballot for mayor in November after winning the Republican mayoral primary, but lost to Democrat Joseph DiMartino.
