Court Again Denies Attempt by Wilton to Dismiss Molestation Suit

WILTON, CT — For a second time, a Superior Court judge in Stamford has dealt a blow to the town and the Board of Education in the suit alleging sexual molestation of a preschool child by a Wilton paraprofessional.

On Sept. 25, Judge Mary Elizabeth Sommer denied a motion by the attorney for the town and BOE to further argue to dismiss the lawsuit. The same judge denied the original motion for summary judgement on Aug. 2.

In the lawsuit, John Doe PPA v. Wilton Board of Education Et Al., the family alleges that their son, who was four at the time, was molested by former Miller-Driscoll preschool aide Eric Von Kohorn. Mother, father and child are listed as plaintiffs in the case.

The complaint dates from October 2016 and alleges that Von Kohorn took photographs of the boy while his pants were down in the bathroom. The episode caused extensive permanent emotional and psychological injuries to the boy, according to the complaint.

A status conference is set for Oct. 23, followed by a trial management conference on Nov. 21 and a jury trial on Dec. 11, 2019.
