WINTER GARDEN, Fla. — A repaired car can look showroom-perfect and still be worth thousands of dollars less than it was the morning before a crash. That hidden loss has a name — diminished value — and most drivers don't realize Florida law gives them years to try to recover it. Windermere Collision Center is out to change that. The Winter Garden shop announced an expansion of its Diminished Value Documentation Program to help Central Florida vehicle owners file claims within the state's four-year window.

The timing matters. Industry data shows vehicles can lose roughly 10% to 30% of their resale value after a collision, yet a large share of owners never learn they have a legal right to pursue that loss at all.

What Diminished Value Really Means

No matter how skilled the repair, an accident permanently marks a vehicle's history — and that record follows the car into every future sale or trade-in. Citing NADA figures reported through the NAIC Journal of Insurance Regulation, the center notes that vehicles typically lose between 10% and 20% of their pre-accident value depending on how severe the damage was.

Florida recognizes three forms of diminished value: inherent (the lasting stigma of an accident on the record), repair-related (extra loss caused by substandard work or non-OEM parts), and immediate (value lost before repairs even begin, common in total-loss cases). In real numbers, the shop points to estimates from about $500 for minor accidents to $2,100 for severe damage — with luxury models potentially losing $10,000 to $25,000.

Diminished value isn't only a legal question; it's a repair-quality one. Appraisers examine paint matching, panel alignment, parts authenticity, and structural documentation — and that's exactly where a certified shop pulls ahead. Genuine OEM parts, factory-matched paint, manufacturer-approved frame equipment, and complete repair records all work to limit the loss and strengthen any future claim.

"Most people don't realize their car loses thousands in value the moment an accident hits their vehicle history," said Tom Ramsammy, owner of Windermere Collision Center. The shop's job, he explained, is to pair quality repairs with the documentation drivers need to recover those losses under Florida law.

Knowing Your Rights Under Florida Law

Florida generally recognizes third-party diminished value claims when another driver is at fault, treating them as part of a vehicle owner's right to be made whole. Under Florida Statutes Chapter 95, owners have four years from the date of the accident — not from the day repairs are finished — to file.

The shop outlines a straightforward path: complete repairs at a certified facility, document the vehicle's pre-accident value, obtain a post-repair appraisal from a certified appraiser, submit a written demand with repair records to the at-fault driver's insurer, and negotiate using that appraisal as leverage.
