CANTON, GA — A Canton councilman was arrested recently for allegedly driving under the influence.

Nick Estes, 40, of Canton, was arrested May 14 for DUI and failure to maintain his lane while traveling on Reinhardt College Parkway, according to police. He is scheduled for arraignment on Thursday in Cherokee County State Court, county records show.

Canton City Manager Billy Peppers said the City of Canton is aware of the arrest of Estes.

"At that time, the Chief of Police contacted the City Manager and per the City Charter, the City Manager made the Mayor aware of the situation," Peppers said. "As this case is in the judicial process, the City will have no further comment."

The police report said Estes was pulled over at Riverstone Plaza after the officer witnessed his car swerve within the lane. Estes initially said he had not been drinking, but then agreed to take a sobriety test. He later admitted he had one, then two drinks. His breath alcohol content results came back at 0.119, police said.

Estes and his attorney filed a motion to suppress evidence alleging Estes was illegally detained by the officer, therefore the sobriety test should be thrown out of evidence for the trial.

This is Estes' first term as council member, and he's been a Canton resident for more than 10 years. Estes currently serves as the Finance Vice President of a publicly traded company in Cherokee County and previously held roles as a finance executive for Home Depot and General Electric.

According to the city's website, "Estes enjoys brewing beer and expanded that passion into becoming part owner of Stout’s Growlers, which is a craft beer and wine market in Downtown Canton."
