As a Muslim woman myself, I was extremely happy to hear that Samantha Elauf won against Abercrombie & Fitch, who was denied a job simply because her headscarf failed to meet the company’s “look policy.” I am very grateful to the American justice system that recognized the rights of this woman. Wearing the headscarf is a religious obligation that should not face any kind of discrimination. Samantha’s headscarf is part of her Muslim identity. She should not have to compromise her religious practice in order to be accepted for a job.
Women who wear the headscarf are protected by the legislation, along with the First and Fourteenth Amendments of the US Constitution. Unfortunately, Muslim women like Samantha Elauf still face discrimination in the workplace. The positive result of this case is a wakeup call for all Muslim women being discriminated because of their dress. For a country based on freedom of expression, religion, and speech, we should not have to fight for our rights. Instead, we should be treated as equals.
