β€œThe shooter has been identified as Clayton County Sheriff Victor Hill,” police spokesman Sgt. Brian Doan said Sunday. ”The shooting has been reported as accidental.”

Gwinnett County District Attorney Danny Porter told WSB Radio in a morning interview that Hill wasn’t detained because state law says an active sheriff can only be charged via a warrant issued by a Superior Court judge.

Police said Monday Hill called 911 at 5:39 p.m Sunday to report the shooting. He and the woman were the only people in the house at the time of the shooting, police said.

McCord is an agent for Paran Realty and worked at the model, the Atlanta Journal-Constitution reported. Hill and McCord are acquaintances, the newspaper said. She was unable to say what happened due to her medical condition.

Police said Sunday Hill β€œrefused to speak with investigators” and was released from the scene. No charges have been filed as the investigation continues.

β€œAs we would with any other investigation, we are working in conjunction with the Gwinnett County District Attorney’s office to ensure that the proper legal process is followed,” police said Monday.

Meanwhile, police were trying to reconstruct what happened, and once they do, Porter said a decision on whether or not to charge the sheriff will be made.

β€œThere are certain legal requirements and steps that have to be taken,” Sgt. Doan told reporters Sunday, according to WSB-TV’s report.

The AJC reported Hill is in his second term as Clayton County’s sheriff β€” he served 2005-2008 and was elected again in 2012, despite allegations of racketeering. He was acquitted in 2013.

Police Monday the recording of the sheriff’s 911 call will not be released at this time.
