Settlement Reached Between Buckhead Mall Owner, Restaurant Company

The terms of the settlement have not been disclosed, and it is not known if the mall owner will take possession of Twist and Prime.

An ongoing lease dispute between the owner of two Buckhead malls and a company operating restaurants in both locations has been settled, according to the Atlanta Business Chronicle.

Simon, who owns Phipps Plaza and Lenox Square malls, has come to an agreement with Tom Catherall’s Here to Serve restaurants over claims that placing the deeds to the properties in Catherall’s ex-wife’s name as part of a divorce settlement violated Twist and Prime’s leases.

Simon had wanted monetary damages from Here to Serve, and was also looking to take over the spaces occupied by Twist at Phipps Plaza and Prime at Lenox Square.

Terms of the Feb. 24 settlement, including any potential Simon takeover of Twist and Prime, were not immediately available, the Chronicle said.

Last month, Buckhead’s Neighborhood Planning Unit (NPU)-B recognized Leigh Catherall as the owner of both restaurants and of Here to Serve properties Aja and Coast.
