Aurora Man Charged After Battering, Threatening To Shoot Person: APD

Officers fired a "less-lethal direct impact round," injuring the man, after worrying he would injure more people, officials said.

AURORA, IL — An Aurora man is facing multiple charges after battering and threatening to shoot a person and attempting to bite a police officer, officials said.

Police responded at about 11:15 p.m. Wednesday to the 1800 block of Lily Street after receiving a 911 call about a man armed inside his home. The caller informed police multiple people were inside the house, where the man battered and threatened to shoot someone, officials said.

Once at the residence, officers attempted to make contact with people inside, but after getting no response, they waited until 23-year-old Wilmer Evaristo exited the house.

Evaristo did not comply with officers' orders to surrender and attempted to go back inside. Officials said police feared he would harm people inside, so they deployed a "less-lethal direct impact round," injuring the man and arresting him after he fell to the ground.

While he was escorted away from the residence, Evaristo pushed against police and attempted to bite one officer, minorly injuring him, officials said. Aurora Fire Department medics took the officer to a local hospital, and he was released a short time later.

Police conducted a search of the residence and found a defaced handgun, which was connected to Evaristo, officials said.

Evaristo was charged with the following:

  • Two counts of unlawful use of a weapon by a felon
  • Two counts of Firearm Owner’s Identification Card ineligible
  • Possession of a defaced firearm
  • Aggravated resisting a peace officer causing injury
  • Two counts of domestic battery
  • Aggravated assault

After his arrest, Evaristo appeared in court, where his bond was set at $250,000. He is currently being held in the Kane County jail.

"Police officers often deal with incidents that are tense, uncertain and rapidly evolving," Chief Keith Cross said in a statement. "The Aurora Police Department is committed to regularly training officers and equipping them with the less-lethal tools needed to peacefully end incidents such as these."
