Aurora Man Sentenced To 6 Years For Fatal DUI Crash In 2020
His blood alcohol concentration was over double the legal limit when he crashed into a tree in 2020, killing his passenger, police said.

AURORA, IL — An Aurora man was sentenced to six years in prison three years he crashed his car into a tree while driving under the influence, killing his passenger, officials said.
Gustavo Gutierrez Aguilar, of the 1-99 block of Margaret Lane, pled guilty on May 18, 2023, to the offense of aggravated driving under the influence causing death, a felony.
Around 6 p.m. Dec. 13, 2020, the now-38-year-old was driving a 2007 Ford Mustang near Moutain Street and Austin Avenue in Aurora Township when the car hit a tree.

A passenger, who was unconscious and not breathing inside the car when paramedics first arrived, died shortly after reaching a local hospital, Patch reported. Police identified the passenger as 29-year-old Lazaro Rosas-Garcia, of the 1000 block of Rainwood Drive.
Police tested Gutierrez Aguilar to find his blood alcohol concentration was 0.206, more than double the legal limit. His license was revoked as a result.

Gutierrez Aguilar is required by law to serve at least 85 percent of his sentence. He received credit for the 988 days served in the Kane County jail.
“Lazaro Rosas-Garcia's death was a preventable tragedy, and I hope his loved ones are able to move forward with this sentence," Assistant State's Attorney David Belshan said in a statement.
Belshan continued: "Our office will continue to vigorously prosecute these cases to hold offenders like Mr. Gutierrez Aguilar accountable for their actions and to send a message that responsible driving is important to keep our community safe and that there are serious consequences for those who make dangerous decisions."
