Home Invasion Prompts Lawsuit Against Couple

The Will County Courthouse lawsuit was filed by Giamanco Law Partners.

BOLINGBROOK, IL - On Sept. 28, 2016, Sharon Davis was alone at her home in Bolingbrook. Her doorbell rang. When she went to the door, a man wearing a ski mask forced his way into her home. The intruder pulled out a gun and threatened to use it. Last week, the Bolingbrook woman filed a civil lawsuit at the Will County Courthouse against William McGuire Jr. and Susan McGuire. The lawsuit accuses William McGuire, now 68, of committing assault and battery, willful and wanton conduct, intentional infliction of emotional distress and negligent infliction of emotional distress.

"Unbeknownst to Plaintiff, defendant, Mr. McGuire had followed the plaintiff home after initially seeing her at a retail store," the lawsuit states. "Prior to September 28, 2016, plaintiff and defendant Mr. McGuire had no relationship.

"Upon plaintiff opening the door, the defendant, Mr. McGuire, forcibly shoved his way into the home of plaintiff Sharon Davis, prying the front door open further than plaintiff Sharon Davis had permit."

William McGuire was subsequently arrested by the Bolingbrook Police Department on Dec. 5, 2016. He spent four days in the Will County Jail before posting 10 percent of his $750,000 bail, jail logs show.

His criminal case has not yet gone to trial at the Will County Courthouse. He and his wife reside in Carol Stream, the lawsuit states. The lawsuit was filed by Giamanco Law Partners in Bolingbrook.

The lawsuit states that "upon trespassing into the home, defendant Mr. McGuire brandished a firearm and threatened plaintiff with it."

McGuire then clutched his victim against her will, her lawsuit states, "in the living room of her home as plaintiff attempted to fight off defendant Mr. McGuire. While holding ... Sharon Davis in his grasp, defendant, Mr. McGuire, aggressively pressed the firearm into the head of the plaintiff, shouting threats at her as he forcibly restrained her."

While fighting off McGuire, the two "fell to the ground" and that caused Davis to make "hard contact with her head against the ground," her lawsuit states.

The lawsuit indicates the Bolingbrook woman suffered significant pain and suffering as well as mental anguish, medical expenses and "severe emotional distress that will continue into the future and will necessitate future treatment."

Her lawyer demands a judgement against William McGuire in excess of $250,000.

The defendant's wife is also named in the lawsuit because Susan McGuire is accused of "transferring assets from defendant Mr McGuire to (her) due to the threat of future litigation."
