Court Upholds Sentence For Man Who Sexually Assaulted Woman, 80
"He has certainly earned each and every day of his sentence," DuPage County State's Attorney Robert Berlin said.
WESTMONT, IL — An appellate court recently upheld a 100-year sentence for a man who was found guilty of breaking into an 80-year-old Westmont woman's apartment and sexually assaulting her on New Year's Day of 2015.
Police say Tevin Rainey, 26, was armed with a gun when he forced his way into the woman's apartment around 5 a.m. Rainey then pushed the woman onto a bed and sexually assaulted her, according to DuPage County State's Attorney's Office.
After sexually assaulting the woman, Rainey then forced her to drive to an ATM at gunpoint and withdraw $320 from her bank account. The woman called 911 after she got home from the incident and Rainey left.

Rainey's attorney's had argued that his sentence was excessive due to his age and background. The appeals court affirmed that the sentence, which is 20 years less than the maximum, was "not an abuse of discretion."
In a statement, DuPage County State's Attorney Robert Berlin said, "Last Friday, the Appellate Court found no error in Judge Telander’s one-hundred-year sentence imposed upon Mr. Rainey."

Berlin added that Rainey's "attempt to reduce his sentence for a crime that the Trial Court correctly deemed a crime that “shocks the conscience of the community” demonstrates Mr. Rainey’s self-consumed, compassionless, repulsive outlook on society. He has certainly earned each and every day of his sentence."
