Evidence to be Protected in UPS Crash Case

Emergency order given by Judge in lawsuit against UPS, driver.

An emergency order of protection of evidence in the lawsuit filed over the December crash where a 30-year-old Evanston woman was hit by a UPS truck was granted by a Cook County judge Friday.

The Chicago Sun-Times reported the order was granted by Judge James N. O’Hara and requires UPS “to preserve and protect evidence from the crash, including cell phone records of the truck’s driver and data recording devices for the truck and its driver for the 24 hours leading up to the crash.”

Evanston police reported on December 22 that Erin Hinner was crossing Ashland Avenue near Ryan Field when she was hit by a UPS truck driven by Gabriel Garcia, who is named in a lawsuit filed January 15 in Cook County Circuit Court.

The suit claims the truck rolled over her and pinned her body under its axle, trapping her for 30 minutes.
