Prosecutors said that Herring made a statement to police stating that the fake weed belonged to the driver. Herring allegedly told police he was holding the synthetic pot for the driver “because he is a friend.”
Herring was sentenced to probation for criminal damage to state property and unlawful possession of fraudulent credit cards last month, prosecutors said.
Judge Felice set bail on the new charge at $100,000. Herring has another hearing for violation of probation.
