Assistant public defender tells judge Burbank battery was a "mutual combat" situation.

A man was charged after he clubbed his uncle in the back of the head with an iron, prosecutors said in court on Thursday.

Arthur Nevarez, 59, was charged with aggravated domestic battery. Prosecutors said that Burbank police were dispatched to a home for a report of a fight on July 8.

Prosecutors said that when officers arrived they found Nevarez’s uncle bleeding from the back of the head. Witnesses told police that Nevarez hit his uncle in the head with an iron.

Nevarez allegedly admitted to hitting his uncle in the head with the appliance. His uncle received six staples to close the wound.

The assistant public defender told the judge that Nevarez also received three staples and that it was more of a “mutual combat” situation.

Given Nevarez’s criminal background, including a conviction for involuntary manslaughter in 1997, the judge set bail at $50,000.
