$630,000 Refund Wanted If 5 Corners Gas Station Nixed
The developers want the $630,000 they paid for the property back if village lawsuit quashes plan.

GLEN ELLYN, IL — The fight between villagers and gas station developers over Five Corners in Glen Ellyn continues, with developers recently requesting more than half a million dollars back if they can't build. The proposed gas station continues to face resistance after a judge recently allowed an ongoing lawsuit to move forward that would prevent the construction.
The developers, Truenorth Energy, reportedly paid a total of $630,000 for the land, Daily Herald Reports. The gas station's proposed site would be on Five Corners, an area long recognized as one of the gateways to Glen Ellyn.
After the village learned of the proposal, a group of residents filed a lawsuit in May to block the gas station's construction. Their arguments against the gas station include aesthetic and environmental concerns, in addition to public safety matters.

Developers fought to get the lawsuit dismissed, but on Dec. 11, DuPage County Judge Bonnie Wheaton ruled that the lawsuit could move forward.
This decision has led Truenorth Energy to pursue their current request to change the original agreement with the village in an effort to get back the $630,000 they originally paid. According to Daily Herald, the village will decide whether this is an option on Jan. 8.

The lawsuit against the gas station plans will have a status hearing on Jan. 25.
