Mother Sues Joliet District 86 After Son Slips In Boys Bathroom
Chicago lawyer Joseph Curcio filed the civil lawsuit on behalf of student Treyvon Smith and his mother Vitinee Harrison.

JOLIET, IL - The mother of a student at Lynne Thigpen Elementary School has retained a Chicago law firm to bring a civil lawsuit against her son's school and Joliet Public Schools District 86. The suit seeks unspecified monetary damages on behalf of Treyvon Smith. The lawsuit was filed this month at the Will County Courthouse by his mother Vitinee Harrison. The entire lawsuit, filed by attorney Joseph Curcio of Curcio Law Offices on North Clark Street in Chicago, is three pages in length.
According to the plaintiff's version of events, Treyvon Smith is enrolled as a student at Thigpen elementary, 207 South Midland Avenue. On Halloween, "Treyvon Smith entered the boys' bathroom ... during his lunch recess and slipped on a liquid substance on the floor," Attorney Curcio informed the court.
Curcio's lawsuit leveled five allegations of negligence against Lynne Thigpen Elementary related Treyvon's slip and fall incident. The key allegations accuse the Joliet school district of having "allowed a liquid substance to remain on the floor of the boy's bathroom" and having "failed to warn the students, including Plaintiff, of the dangerous condition of the floor in the boys bathroom when Defendants knew or should have known that warning was necessary to prevent injury to the students including Plaintiff."

According to the suit, Treyvon "sustained severe and permanent injuries."
The lawsuit contends Treyvon "will continue to experience pain and suffering; was caused to suffer a lasting disability; was caused and will continue to spend substantial sums of money for medical care and treatment ..."

Joliet Patch reached out to District 86 earlier this week. The communications director said the district had no comment and school district's lawyers had not received a copy of the lawsuit, she relayed.
