Woman Sues Loop Bar Over Fall Into Open Fire Pit

Woman alleges Vertigo Sky Lounge did not properly supervise patrons around outdoor fire pit.

A woman is suing the owners of a popular Loop bar over over claims that she fell into an open fire pit while on the outdoor balcony, causing her to suffer burns.

Kathleen Dalby filed a lawsuit on Sept. 25 in Cook County Circuit Court against Dana Hotel LLC, doing business as the Vertigo Sky Lounge at 660 N. State St..

Dalby alleges that she was an invited guest of the bar that maintains an outdoor rooftop lounge on the 26th floor on Aug. 5, 2014.

The plaintiff was on the balcony with other patrons around an open fire pit surrounded by seating, the complaint said.

While on the balcony, Dalby alleges that she fell into the fire pit and suffered burns.

The lawsuit contends that the bar failed to properly supervise patrons on the premises and maintained an unguarded open fire pit in a public area.

In addition to her injuries, the lawsuit alleges that Dalby suffered personal and monetary damages.

The plaintiff is asking for $50,00 in damages.

The case is being represented by attorney Theodore C. Jennings of the McNabola Law Group in Chicago.
