Judge to Decide in May on Evidence in Joliet Woman's Teen Sex Case

A Will Co. judge said he needed more time to review Margarita Hernandez's case before deciding whether or not admit evidence.

A Joliet woman will have to wait until next month to learn whether evidence obtained during a federal child pornography investigation will be admissible in her underage sex case, according to a Herald-News report.

A Will County judge scheduled a continuation for May 5 so he would have more time to review the case of Margarita Hernandez, 35, the report stated. Hernandez is accused of having sex with a 15-year-old boy in 2012.

A video recording of Hernandez having sex with the teen was reportedly found when federal investigators executed a search warrant of the house she shared with John Gabriel, 78, in February. The warrant was part of an investigation into Gabriel, who was found guilty last month on child pornography charges in federal court.

Hernandez’s lawyer requested last month that any evidence found via the search warrant be suppressed because it was “stale,” the report stated.
