Hutchins Park Use Prompts Lawsuit: Report

Is the city's use of Hutchins Park over the top? One lawsuit claims so.

HAVRE DE GRACE, MD — Property owners near a city parks off Congress Avenue have taken their grievances to the judicial system.

Neighbors of Hutchins Park have reportedly filed suit against the city of Havre de Grace due to its use of a "party tent" that draws crowds and has in some cases made it impossible for residents to access their property, according to The Aegis.

Court records show that Barbara and Gary Pensell as well as 211 Congress LLC filed the civil complaint against the mayor, city council and city of Havre de Grace on March 28.

This is not the first time that property owners have taken to the courts to settle a dispute with the city over its use of Hutchins Park.

According to The Aegis, a homeowner in 2003 filed a similar suit for breach of contract over land use and received a settlement.

In recent years, the city has increased its usage of Hutchins Park, opening a skating rink in the winter months and relocating the farmers market there from Pennington Avenue.
