Ex-Suffolk Assistant DA Charged In NYC Rape: Officials

Adam Foss, a former prosecutor and founder of the group Prosecutor Impact, was indicted Tuesday on rape and sex abuse charges.

BOSTON, MA — A former Suffolk County assistant prosecutor was indicted in New York City Tuesday on rape charges, accused of sexually assaulting a sleeping woman in Manhattan in 2017.

Adam Foss had previously been accused of inappropriate behavior while working in the Suffolk County District Attorney's Office, and had been accused of sexual assault by women outside the DA's office.

Manhattan District Attorney Alvin Bragg Jr. on Tuesday charged Foss with first-degree rape and first-degree sexual assault.

"[On] Oct. 21, 2017, Foss ... met the 25-year-old survivor at a Midtown hotel after exchanging calls and texts for approximately one month," Bragg said in a news release. "After the survivor repeatedly said no to Foss' sexual advances, the two fell asleep, before Foss allegedly raped the woman as she slept."

Foss, 42, who lives in Los Angeles, founded the nonprofit Prosecutor Impact in 2016 to improve "community safety in the United States through a better understanding of the most important actor in the criminal justice system: the criminal prosecutor."

In late 2020, former Suffolk County DA Rachael Rollins hired a private law firm to investigate whether Foss acted inappropriately in the prosecutor's office while working there between 2008 and 2016. Accusers also said he acted unethically and abused his authority. The report released in April 2021 found Foss' behavior was "troubling" but not criminal, according to WBUR.

Writer and singer Raegan Sealy in 2020 published a blog post accusing Foss of raping her after the two met at a conference. It was not clear if that incident was linked to the indictment announced by prosecutors Tuesday.
