U.S. Attorney Carmen Ortiz is debating whether to enforce federal restrictions that would force a planned medical marijuana dispensary in Brookline to be moved away from places where children congregate, including schools and parks.
New England Treatment Access plans to build the dispensary at 160 Washington St., which is within 1,000 feet of two schools and several playgrounds, according to the Boston Globe.
Federal regulations prohibit dispensaries from being located within 1,000 feet of schools and playgrounds. The authority to enforce those rules rests with the state, according to the Globe.
