His lawyer recently told the New York Daily News the crane operators shouldn't have been moving the crane because of the windy conditions.

"This was not an act of nature," the lawyer, Jonathan Damashek, told the Daily News. "This wasn't a tornado that came out of nowhere."

The Daily News reported O'Brien filed a complaint against the city's Department of Buildings and plans to sue it for $30 million in damages.
